Recalls/Retakes Clause Samples
The Recalls/Retakes clause establishes the conditions under which a party may request a repeat or replacement of a previously delivered product, service, or performance. Typically, this clause outlines the circumstances that justify a recall or retake, such as defects, non-compliance with agreed specifications, or unsatisfactory quality, and may specify the process for notification and resolution. Its core practical function is to provide a clear mechanism for addressing and correcting deficiencies, thereby ensuring quality control and protecting the interests of both parties.
Recalls/Retakes. Prior to first televising of commercials made for a particular advertiser, principal performer may be recalled for one session fee to make reasonable changes and corrections in existing sound track or to make changes or corrections in photography in the nature of retakes. Subsequent calls for such purpose will require separate applicable payment for each commercial in connection with which such services are rendered. In no event may any fees payable under these provisions be credited against any other compensation due principal performer.
