Real Property Disposition. (Surplus Property) 5.1 Services shall include Real Estate Appraisal Practices defined under USPAP and allowed under Texas State Law. 5.2 Shall provide advance notice to the State, the date and time of their physical inspections of the subject property in order to coordinate the inspection with State staff, if applicable. 5.3 Shall prepare a complete appraisal report for the assignment on each parcel. The report may be in a narrative format or placed on an appraisal form when appropriate. There are no specific form requirements for real property disposition appraisals. 5.4 Shall prepare written notification to the State of any environmental concerns associated with the right of way to be sold, which could require environmental remediation, if applicable. 5.5 The fees for real property disposition assignments shall be based on hourly rate shown in Attachment D-1, Fee Schedule.
Real Property Disposition. Any real property under the control of OWNER that was acquired or improved in whole or in part with grant funds in excess of $25,000 shall either be disposed of in accordance with 24 CFR 570 resulting in the CITY being reimbursed in the amount of the current fair market value of the property less any portion of the value attributable to expenditures of non-grant funds for improvement to the property. Such reimbursement shall not be required if disposition occurs more than five (5) years after expiration of this Agreement.
