Readiness of the Project for Implementation. The detailed design for project 1 has been completed, tender documents approved by ADB, and bids for the major ICB civil works contract already invited.  Preparation of bidding documents for goods is in process.  Consultants selection recruitment notice for supervision consultants published and shortlisting underway.  Counterpart funding is available. Safeguards Project 1 does not have any major environmental impacts. In line with ADB’s Safeguard Policy Statement, 2009, project 1 has been classified environment category B. The Road Fund has prepared an initial environmental examination for project 1 and an environment assessment and review framework for the investment program. Civil works under project 1 do not involve land acquisition, involuntary resettlement, or affect ethnic minority groups in all forms as describe in the ADB’s definition of indigenous peoples under ADB’s Safeguard Policy Statement. Project 1 is classified category C for the purposes of social safeguards. The Road Fund has prepared a land acquisition and resettlement framework and an ethnic minority planning framework for the investment program. The safeguard document have been prepared in consultation with affected people and information contained therein disclosed to affected people in accordance with the requirements of ADB's Safeguard Policy Statement and has been posted on the Road Fund website following ADB clearance. Bidding document for one package under the grant components is still being prepared. (ii) Request for Proposal issued to two out of four construction management and supervision consultant packages. Readiness of the Project for Implementation. A feasibility study was completed and was approved by the relevant authorities in August 2010. A detailed design for Project 1 will be completed by October 2010. A Land Acquisition and Resettlement Framework (LARF) for the investment program and a land acquisition and resettlement plan (LARP) for Project 1 have been completed. An Environmental Assessment and Review Framework (EARF) for the investment program and an initial environmental impact examination (IEE) for Project 1 have been prepared. Safeguards Environment: Project 1 is categorized as environmental Category B since project 1 will not have any major environmental impacts. Following ADB’s Safeguard Policy Statement (SPS) (2009), Kazakhstan laws and regulations, and EARF, MOTC has prepared an IEE for project 1. The IEE assessed the environmental impacts of the project road and prescribed environmental protection and mitigation measures. No major negative impacts are expected. Resettlement: Project 1 is classified as involuntary resettlement category B since it does not involve any major land acquisition, involuntary resettlement, or affect ethnic minority groups. MOTC has prepared a LAPR for Project 1, following Kazakhstan laws and regulations, the LARF, and ADB's SPS (2009). EARF, LARF, and LARP have been disclosed in August 2010. Indigenous Peoples: Project 1 does not trigger safeguards for and requirements from indigenous peoples under ADB’s SPS (2009) and no indigenous development framework or plan is required. LARF, EARF, IEE, and LARP are attached as Annex 5.

Readiness of the Project for Implementation. With ADB support, Damu has developed a market-based credit lending program for SMEs for their expansion and modernization – this program differs from the existing credit lines currently being provided to SMEs by Damu. These existing credit lines implement the Government’s diversification strategy, have a focus on priority sectors, and includes limits on interest rates charged to SME borrowers. SME demand for medium term market-based credit has been confirmed along with PFI demand for the new market-based product. New streamlined monitoring and implementation procedures have been developed for the market-based program. The basic terms of relevant local currency financing arrangements and the financing structure to enable the provision of medium term local currency denominated credit at market-based costs under this tranche have been agreed by ADB, Damu and RoK. A set of eligibility criteria for PFIs to obtain subloans from Damu by using the proceeds of the proposed loan under this tranche has been agreed with ADB, and based on such criteria, eligible PFIs have been identified and relevant due diligence has been completed. A set of the eligibility criteria for SMEs to obtain loans from PFIs has also been established, along with a monitoring framework to track implementation progress and achievement of key project outputs and outcome. Safeguards The loan proposed under this tranche has been categorized according to ADB's standards as "FI" with respect to environment and social safeguards. Because the subprojects financed under this tranche will have minimal or no adverse environmental or social risks, the project to which this tranche relates is treated as category "C". The SMEs loans made and credit lines extended by PFIs under this tranche will conform to ADB's Safeguard Policy Statement (2009) and will comply with all applicable requirements of Kazakhstan's labor and environmental legislation and regulations. PFIs will make only those SME loans or credit lines which have minimal or no adverse social or environmental risks. Any loan made or credit lines extended by PFIs to SMEs, which: (i) falls under ADB's environmental and social safeguard categories "A" or "B", and/or (ii) specifically requires environmental assessment clearances by the Government, will not be financed by using the proceeds of the proposed loan under this tranche.   • Construction of the Project The Allottee has seen the proposed layout plan, specifications, amenities and facilities of the Apartment/ Plot and accepted the floor plan, payment plan and the specification, amenities and facilities annexed along with this Agreement which has been approved by the competent authority, as represented by the Promoter. The Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities. Subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent authorities and shall also strictly abide by the bye-laws, FAR, and density norms and provisions prescribed by the relevant building bye-laws and shall not have an option to make any variation/ alteration/ modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter shall constitute a material breach of this Agreement.

  • Execution of the Project Section 3.01. (a) The Borrower declares its commitment to the objectives of the Project as set forth in Schedule 2 to this Agreement, and, to this end, shall carry out the Project with due diligence and efficiency and in conformity with appropriate administrative, financial and technical practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project.

  • COMMENCEMENT AND COMPLETION OF THE PROJECT Section 3.01 The Project
