Rates and Prices. A. The Concessionaire shall keep at all times on public display, the prices, rates, and charges which may be charged for the sale of goods and services to the public. The maximum prices charged for services shall be no greater than a written schedule thereof, submitted to and approved by the Director prior to the initial opening date of the concession and by March 1st of each subsequent year of operation.

Rates and Prices. Where any rates and prices in the Schedule of Rates are used under clause 9.3(b), the rates and prices will be deemed to cover: all labour, materials, overheads and profit related to the work the subject of the Variation and compliance with the Consultant’s obligations under the Contract; and all costs and expenses which will be incurred by the Consultant arising out of or in any way in connection with the Variation.

Rates and Prices. The rates and prices inserted by the Contractor in the Bill of Quantities are to be the full and inclusive value of the work described. They must also take into account the conditions referred to in the general Conditions, and include time lost due to weather, payment of guaranteed minimum and holidays with pay. The cost of any travelling time subsistence and incentives such as overtime etc. must be included in the rates and prices. Where any special risks, liabilities and obligations, mentioned above or otherwise, cannot be dealt within the rates, then the price thereof is to be separately stated in items provided for the purpose or added by the Tenderer. Any item left unpriced shall be held to have had its cost included in the unit rates for other items of work.

The maximum prices charged for beverages, food and services shall be no greater than a written schedule thereof including the portion scale, submitted to and approved by the Director prior to the initial opening date of the concession and by March 1st of each subsequent year of operation.
Rates and Prices. Pricing shall be prepared with the following contract terms considered. For acquisitions that include Building Maintenance Services, this instruction is in addition to annual Prevailing Wage adjustments that have been required and specified elsewhere within this solicitation. Pricing shall be fixed and firm throughout the original contract term or for two years, whichever date is earliest. At that time, the Vendor may submit a written request for a price increase. The written request is to be at least 90-days in advance. Thereafter, written request for price increases shall only be considered upon the contract anniversary date (such price increase requests are to be submitted at least 90-days prior to the contract anniversary date). Such requests shall consider the following: Price request shall be no greater than the total of changes to the CPI Index for King County or other pricing index appropriate to the particular product herein; Not produce a higher profit margin than that on the original contract; Clearly identify the items impacted by the increase; Be accompanied by documentation acceptable to the Buyer sufficient to warrant the increase; And remain firm for a minimum of 365 days. The request shall be considered by the Buyer and may be accepted or rejected. Failure to submit a price request at least 90-days prior to the contract anniversary date, shall result in a continuation of all existing pricing on the contract until the next contract anniversary date. The decision to accept any price increase will be at the sole discretion of the Buyer. The Buyer may exempt these requirements for extraordinary conditions that could not have been known by either party at the time of bid or for other circumstances beyond the control of both parties, in the opinion of the Buyer. Cost Reductions: Any cost reductions to the Contractor, such as rebates or “specials”, shall be reflected in a reduction of the contract price effective immediately. Seattle will not be bound by prices contained in an invoice that are higher than those in the contract. Unless the higher price has been accepted by the City and the contract amended, the invoice may be rejected and returned to the Contractor for corrections.
