Common use of Rate Review Clause in Contracts

Rate Review. Franchisee shall submit to the City an application for rate review annually, in accordance with the procedures described in the “City of San ▇▇▇▇ Obispo Rate Setting Process and Methodology Manual for Integrated Solid Waste Management Rates,” dated June 1994, except as that may be modified by the City from time to time. In addition to the procedures contained in the above referenced manual, Franchisee shall submit any and all data requestedby and in the format prescribed by the City. In the event Franchisee shall fail to meet the schedule set forth in the above referenced manual, a revision of rates for the following year shall not be authorized until the 1st day of the first calendar month following a 120 day period from the date that the complete application is submitted and such revision shall contain no consideration for Franchisee’s failure to submit the application in accordance with the schedule set forth in the above-referenced manual.
