Railroad Protective Liability. When working adjacent to a railroad, the Consultant and its Sub-consultant consultants shall carry Railroad Protective Liability Insurance, as required by the Railroad. If performing work within 50 feet of a railroad right of way, Consultant or Sub-Consultant will ensure that its Commercial General Liability insurance does not contain an exclusion for work in or near a railroad right of way and shall provide documentation of this to the Authority before commencing work.
