Common use of Quality/Special Features Clause in Contracts

Quality/Special Features. Design Professional is responsible, to the extent necessary to perform the Services, at no additional charge to the City, to fully familiarize itself with the special and/or unique qualities and/or requirements of the Services, the Project, the Project site, and the City. Notwithstanding the foregoing, Design Professional shall not be required to undertake or perform a geotechnical investigation, materials sampling or testing, construction cost estimating, or other special investigation of existing conditions unless the same is included in the Scope of Services. The City's determination as to the level of quality required and on all aesthetic issues shall be final and binding.
