QUALITY AND SAFETY. All materials used for the manufacture or construction of any supplies, materials or equipment covered by this bid shall be new. The items bid must be new, the latest model, of the best quality, and highest grade workmanship that meet or exceed federal safety standards. Products requiring certification should require certification of options in cases where non-certified options could result in the decertification of the original product or warranty. In all cases where options are not certified, the Vendor must disclose to the end user that the non-certified options are not required to be certified. All options must meet or exceed federal safety standards.

Bidders shall offer only those brands qualified and listed in Cooperative Approved Tire List (CATL), latest edition in effect at the time of this solicitation, published by the Associated Consultants of Technical Services, Inc., the contract manager for the Federal Government’s program for testing new tire performance. In lieu of being listed in the publications, a Bidder may provide a Qualification Certification Form signed by the CATL Program Administrator. Tires bid must meet the following standards: • ASTM Standard F1922, Test Method-for Tires, Pneumatic, Vehicular Highway. • ASTM Standard F1923, Test Method-for Tires, Pneumatic, Vehicular Low Speed, Off Highway. • ASTM Standard for Rubber Tires.
QUALITY AND SAFETY. The Bidder shall provide the names of at least 3 reputed agencies with experience of conducting quality and safety checks in similar works. IWAI shall approve one of the three agencies to certify design and technical specifications and conduct testing and commissioning for final certification.
QUALITY AND SAFETY. (i) Notwithstanding anything in this Agreement to the contrary, all Materials (including Licensed Product provided pursuant to Section 4.3(a)) provided to OST by or on behalf of Advaxis are provided on an “AS-IS” basis and subject to the disclaimer of Section 9.4 of the Agreement. QUALITY AND SAFETY. Supplier shall manufacture the Products in accordance with normal and customary quality requirements, standards and expectations of leaders within its industry unless otherwise specified in a separate signed Product Plan. In the event either Supplier or Fortinet becomes aware of any information which reasonably supports a conclusion that a hazard may exist in any Product and the defect could cause death or bodily injury to any person or property damage (a "Hazard"), the party becoming aware of this information shall notify the other of the potential Hazard. Whenever possible, notification to the other party shall precede notice to any governmental agency, unless required by law. Supplier and Fortinet shall promptly exchange all relevant data and then, if practical, as promptly as possible, meet to review and discuss the information, tests, and conclusions relating to the alleged Hazard. At this meeting the parties shall discuss the bases for any action, including a recall, and the origin or causation of the alleged Hazard. Supplier shall be responsible for the costs of effecting a recall including, but not limited to, the reasonable out-of-pocket costs to Fortinet directly related to the recall. Each party shall, on request, provide to the other reasonable assistance in (i) determining how best to deal with the Hazard; and (ii) preparing for and making any presentation before any governmental agency which may have jurisdiction over Hazards involving Products.
