Qualified Operator. Seller or an Affiliate of Seller shall operate and maintain the Facility or cause the Facility to be operated and maintained by an entity that has at least two (2) years of experience in the operation and maintenance of similar facilities of comparable size and characteristics to the Facility. Seller must provide PacifiCorp thirty (30) days prior notice of any change in the operator of the Facility.
Qualified Operator. From and after the Commercial Operation Date, Seller or an Affiliate of Seller shall itself operate and maintain the Facility or cause the Facility to be operated and maintained by an entity, approved by PacifiCorp (such approval not to be unreasonably withheld, conditioned or delayed), that has at least two years of experience in operation and maintenance of wind energy facilities of comparable size to the Facility. Seller shall provide PacifiCorp thirty (30) days prior written notice of any proposed change in the operator of the Facility.
Qualified Operator. Operator declared as such by reason of having proved that it complies with the technical Tender Qualification requirements, or who takes its place in accordance with the Contract. In the Concession Holder’s shareholding structure, it shall have and maintain the ownership of the Minimum Participation.
Qualified Operator. From and after the Commercial Operation Date, Seller or an Affiliate of Seller shall itself operate the Facility or cause the Facility to be operated by an entity that has at least two years of experience in operation of solar energy facilities of comparable size to the Facility. Seller shall provide PacifiCorp 30 days prior written notice of any change in operator.
Qualified Operator. Legal person that complies with the technical Tender qualification requirements. In the CONCESSIONAIRE’s shareholding structure, the Qualified Operator shall have and maintain the ownership of the Minimum Participation.
Qualified Operator. From and after the Commercial Operation Date, Seller or an Affiliate of Seller shall itself operate the Facility or cause the Facility to be operated by an third party entity. Seller shall provide PacifiCorp 30 days prior written notice of any change in operator.
Qualified Operator. Operator is qualified to obtain any Permits and Environmental Permits necessary for Operator to operate the Facilities as of the Turnover Date. Without limiting the foregoing, Operator is not aware of any reason or circumstance that would prevent Operator from procuring the Operator Required Regulatory Approvals.
Qualified Operator. Lessee is an experienced operator in the delivery of quality care for the residents that will reside in the Facility. Lessee has demonstrated a history of quality care as defined by all regulatory authorities with jurisdiction over the Facility and, other than as disclosed to Lessor in writing, Lessee has not received as to any facility that it owns, leases or operates any of the following sanctions: (i) termination of Medicare certification termination of Medicaid certification; (ii) cancellation of Medicare certification; (iii) termination of Medicaid certification (iv) cancellation of Medicaid certification; (v) exclusion or suspension from the Medicare or Medicaid Programs; (vi) civil penalties pursuant to state law; (vii) Medicaid or Medicare monetary penalties; (viii) denial of payment for new admissions; or (ix) denial of a facility long term care license. Lessee has and will maintain all necessary licenses to operate the Facility, including without limitation any regulatory licenses held in the name of Lessor.
Qualified Operator. Any owner of a Mortgaged Revolving Credit Facility Rig shall cease to be qualified to own and operate such Mortgaged Revolving Credit Facility Rig under the laws of the United States or the jurisdiction in which such Mortgaged Revolving Credit Facility Rig is flagged.
Qualified Operator. Site Based • Qualified pest control operator who is registered as a structural pest control operator who is registered with the department of Agriculture in terms of the Fertilizers, Farm Feeds, Agricultural Remedies and Stock Remedies Act, 1947 (Act No 36 of 1947) • Minimum of three (3) years pest control experience. Qualified Operator - Supplementary • Qualified operator who is registered as a structural pest control operator who is registered with the department of Agriculture in terms of the Fertilizers, Farm Feeds, Agricultural Remedies and Stock Remedies Act, 1947 (Act No 36 of 1947) • Minimum of one (1) year(s) pest control experience. Replacement of Staff Staff removed for any reason whatsoever shall be immediately replaced. Replacement staff shall have the competence and abilities equal to or better than that of the personnel they replace. (Note: If for any reason any staff members are replaced. It is the contractor’s responsibility to familiarise new staff with the requirements of the service. New staff members will not be considered a valid reason for any decline in service levels).
