Qualifications of the. Bidder 6.1 By submission of documentary evidence in its bid, the Bidder must establish to the Procuring Entity’s satisfaction: (a) that it has the financial, technical, and production capability necessary to perform the Contract, meets the qualification criteria specified in the BDS, and has a successful performance history. If a prequalification process has been undertaken for the Contract(s) for which these Bidding Documents have been issued, the Bidder shall, as part of its bid, update any information submitted with its application for prequalification; (For the purposes of establishing a Bidder’s qualifications, and unless stated to the contrary in the BDS, the experience and / or resources of any Subcontractor will not contribute to the Bidder’s qualifications; only those of a Joint Venture partner will be considered.) (b) that, in the case of a Bidder offering to supply key goods components of the Information System, as identified in the BDS, that the Bidder does not itself produce, the Bidder is duly authorized by the producer to supply those components in the Procuring Entity’s country under the Contract(s) that may result from this bidding; (This will be accomplished by including Manufacturer’s Authorizations in the bid, based on the sample found in Section VII.) (c) that, if a Bidder proposes Subcontractors for key services if and as identified in the BDS, these Subcontractors have agreed in writing to serve for the Bidder under the Contract(s) that may result from this bidding; and (d) that, in the case of a Bidder not doing business within the Procuring Entity’s country, the Bidder is or will be (if awarded the Contract) represented by an Agent in that country who is equipped and able to carry out the Bidder’s maintenance, technical support, training, and repair obligations prescribed in the General and Special Conditions of Contract, and/or Technical Requirements. 6.2 Bids submitted by a Joint Venture of two or more firms as partners shall also comply with the following requirements: (a) the bid shall be signed so as to be legally binding on all partners; (b) one of the partners shall be nominated as being in charge, and this nomination shall be evidenced by submitting a power of attorney signed by legally authorized signatories of all the partners; (c) the partner in charge shall be authorized to incur liabilities and receive instructions for and on behalf of any and all partners of the Joint Venture, and the entire execution of the Contract,...

  • Vendor Qualifications Minimum Qualifications Based on the Contractor’s submission, OGS has determined that Contractor met the minimum qualifications for the lot(s) as identified in Appendix G, Contractor and OGS Information. If Contractor is awarded Lot 1 as a New York State Certified Minority- or Women- Owned Business Enterprise or as a New York State Small Business, Contractor agrees that it must retain at least one of such statuses to retain its Lot 1 award.
