Common use of Public Hearing Clause in Contracts

Public Hearing. The LFA shall schedule a public hearing if the LFA seeks to continue its investigation into the alleged noncompliance (i) if Franchisee fails to respond to the Noncompliance Notice pursuant to the procedures required by this Article, or (ii) if Franchisee has not remedied the alleged noncompliance within sixty (60) days or the date projected pursuant to Section 11.2(iii) above. The LFA shall provide Franchisee at least sixty (60) business days prior written notice of such public hearing, which will specify the time, place and purpose of such public hearing, and provide Franchisee the opportunity to be heard.

Public Hearing. The LFA shall schedule a public hearing if the LFA seeks to continue its investigation into the alleged noncompliance (i) if Franchisee fails to respond to the Noncompliance Notice pursuant to the procedures required by this Article, or (ii) if Franchisee has not remedied or commenced to remedy the alleged noncompliance within sixty (60) days or the date projected pursuant to Section 11.2(iii) above. The LFA shall provide Franchisee at least sixty thirty (6030) business days days’ prior written notice of such public hearing, which will specify the time, place place, and purpose of such public hearing, and provide Franchisee the opportunity to be heard.

The LFA shall schedule a public hearing if the LFA seeks to continue its investigation into the alleged noncompliance in the event that: (i1) if Franchisee fails to respond to the Noncompliance Notice pursuant to the procedures required by this Article, or (ii2) if in the event that Franchisee has not remedied the alleged noncompliance within sixty fifteen (6015) days or the date projected pursuant to Section 11.2(iii12.2(iii) above. The LFA shall provide Franchisee at least sixty thirty (6030) business days prior written notice of such public hearing, which will specify the time, place and purpose of such public hearing, and provide Franchisee the opportunity to be heard.

Public Hearing. The LFA shall schedule a public hearing if the LFA seeks to continue its investigation into the alleged noncompliance (i) if Franchisee fails to respond to the Noncompliance Notice pursuant to the procedures required by this Article, or (ii) if Franchisee has not remedied or commenced to remedy the alleged noncompliance within sixty (60) days (or, in the case of a noncompliance as set forth at Subsection 11.2.2, within thirty (30) days) or the date projected pursuant to Section 11.2(iiiSubsection 11.2.1(iii) above. The LFA shall provide Franchisee at least sixty thirty (6030) business calendar days prior written notice of such public hearing, which will specify the time, place and purpose of such public hearing, and provide Franchisee the opportunity to be heard.
