Public Emergency. In the event of an emergency or to protect the public health or safety, prior to the Licensor accessing or performing any work on a Municipal Facility on which Licensee has installed Small Cell Equipment, Licensor may require Licensee to deactivate such Small Cell Equipment if any of Licensor’s employees or agents must move closer to the Small Cell Equipment than the FCC recommended minimum distance. In such case, Licensor will attempt to contact Licensee at [000-000-0000] to request immediate deactivation. Further, Licensee shall install a disconnect device at each Municipal Facility on which it installs Small Cell Equipment pursuant to a Site Supplement so that in case of emergency or to protect the public health or safety where Licensee is not able to immediately deactivate the Small Cell Equipment, Licensor may disconnect such Small Cell Equipment from its power source and safely shut it down.

Public Emergency. In the event that City employees are required to respond to a public emergency, and where the City is able to recover payment for this service, employees must take overtime as payment, i.e. employees will not have the option of banking this time.

Public Emergency. The Laboratory Director or Deputy Laboratory Director may declare that a public emergency exists that effectively prevents employees’ attendance at work or the continuance of work at Xxxxxxxx Livermore National Security, LLC in a normal and orderly manner. In the event of an unplanned power outage or other unplanned cut-off of power, or an emergency, the power-down will be with such advance notice as may be practicable. In all instances, once the work has been completed and the worker(s) have departed the exposure area, the party who accomplished the power-down shall restore power and inform Licensee as soon as possible at Licensee’s Network Operations Center number provided above that power has been restored.

Public Emergency. Township shall have the right to sever, disrupt, dig-up or otherwise destroy Small Wireless Facilities of Company if such action is necessary because of a public emergency. If reasonable to do so under the circumstances, Township shall attempt to provide notice to Company. Public emergency shall be any condition which poses an immediate threat to life, health, or property caused by any natural or man-made disaster, including, but not limited to, storms, floods, fire, accidents, explosions, water main breaks, hazardous material spills, etc. Company shall be responsible for repair at its sole cost and expense of any of its Facilities damaged pursuant to any such action taken by Township.
Public Emergency. To the extent not prohibited by applicable law, in the event of a public emergency or disaster as determined by the City, a ROW User immediately shall make facilities, employees, and property, as may be reasonably necessary, available for use by the City or other civil defense or governmental agency designated by the City for the term of such emergency or disaster for emergency purposes. In the event of such use, the ROW User shall waive any claim that such use by the City constitutes a use of eminent domain, provided that the City shall return use of the Facilities, employees, and property to the ROW User promptly after the emergency or disaster has ended.
