Common use of Protection from Damage Clause in Contracts

Protection from Damage. The Design/Builder shall adequately protect active underground utilities from damage, and if damaged shall immediately effect all necessary repairs. Removal or relocation of active underground utilities shall be done only as indicated on the drawings. If such utilities are in use, they shall be maintained in continuous service. If not indicated on the drawings or not known to exist, the Design/Builder shall report discovery of such utilities to the Owner and shall not proceed further until directed to do so.
