Common use of Property Trustee Clause in Contracts

Property Trustee. Prior to the issuance of the Preferred Securities and Common Securities, the Sponsor shall appoint either the Delaware Trustee or another trustee (the "Property Trustee") meeting the requirements of an eligible trustee of the Trust Indenture Act of 1939, as amended, by the execution of an amendment to this Declaration executed by the Regular Trustees, the Sponsor, the Property Trustee and the Delaware Trustee.

Property Trustee. Prior to the issuance of the Preferred Capital Securities and Common Securities, the Sponsor shall appoint either the Delaware Trustee or another trustee (the "Property Trustee") meeting the requirements of an eligible trustee of the Trust Indenture Act of 1939, as amended, by the execution of an amendment to or restatement of this Declaration executed by the Regular Administrative Trustee (or the Administrative Trustees, if there be more than one), the Sponsor, the Property Trustee and the Delaware Trustee.
