Promotional Pricing. If the pricing (i.e., monthly recurring charges) at which you receive your Service(s) during your Initial Service Term is a promotional rate or is otherwise discounted from Astound’s standard retail rates for the Service(s), the promotional or discounted rate will end at the expiration of your Initial Service Term. In such event, the pricing (i.e., monthly recurring charges) for your Service(s) is subject to change upon the start of the first Renewal Term described in Section 4(d) below, with the new rate not to exceed Xxxxxxx’s then-current standard retail rates for the Service(s).

For orders placed without a valid email, contact will be attempted by phone. If you violate any of the terms or conditions of this Agreement, this Agreement terminates immediately without notice. Bookstore may deny access to the Site to you and anyone claiming by or through you without liability to anyone. Bookstore shall have all additional rights and remedies at law and in equity arising from such violation. Further, you agree to indemnify, defend and hold Bookstore, and its affiliates, suppliers, employees and agents harmless from all claims, actions, losses, liabilities, damages, costs and expenses (including attorneys fees) arising out of or relating to any such prohibited use of the Site. If you violate or infringe upon the rights of any third party, they have all remedies at law and in equity to enforce their rights against you to the extent applicable arising from your actions. Any delay or failure to act with respect to a breach of this Agreement by you or others does not constitute a waiver and shall not limit such rights with respect to such breach or any subsequent breaches. Promotional Pricing. Xxxx may provide the Distributors with Xxxx Programs. Such Xxxx Programs will apply only to resales made to one or more End Users. Any such Xxxx Programs must be provided to the Distributors and to Partner in writing, which includes email notification from Xxxx, and must specify a fixed time period during which such Xxxx Program applies. If no time limit is specified in writing, the time period shall be ninety (90) days from the effective date of such Xxxx Program. Xxxx may condition the Xxxx Program on the Partner’s compliance with the Xxxx MAP Policy. No such condition will prohibit Partner from selling at any price below the prices established by Xxxx.
