During the program year, Frontier will monitor the number of projects implemented by each Project Sponsor, and will attempt to conduct a sufficient number of inspections to maintain a targeted percentage.\n6.7.4 Project Sponsor shall notify TNMP of Measure installation at each Project Site by submitting the project documenting the Measures installed at the Project Site. Each project must be submitted electronically along with all required forms, photos, and other documentation. Within forty-five (45) days of receipt of the submitted project, Fronter may complete a random sample inspection of the Measure installations at the Project Site(s). This inspection shall be used to determine whether the Measures were installed and are capable of performing their intended function of producing Peak Demand Savings and Energy Savings. If TNMP and Frontier reasonably determine that the Measures at the Project Site(s) have been installed, tested and inspected to the extent required by TNMP and found to be capable of providing Peak Demand Savings and Energy Savings in material compliance with the Contract Documents, the invoice will be paid as submitted. The savings attributable to the Measures documented in the approved invoice will be used for purposes of calculating the Incentive Payment.\n6.7.5 Frontier or a third-party evaluator may inspect measures or a sample of measures installed as part of a Project. These inspections shall be used to determine whether the Measures were installed and are capable of performing their intended function of producing Peak Demand Savings and Energy Savings. If Frontier determines that the Measures at the Project Site have been installed, tested and inspected to the extent required and found to be capable of providing Peak Demand Savings and Energy Savings in material compliance with the Contract Documents, the project will be approved as submitted. If Frontier determines that any of the Measures installed at the Project Site are not capable of providing Peak Demand Savings and Energy Savings in material compliance with the Contract Documents, a reduction of savings may be required for purposes of calculating the Incentive Payment.\n6.7.6 Any review, inspection, or acceptance by Frontier, its designee or any third- party evaluator of any Project Site or of the design, construction, installation, operation and maintenance of the Measures is solely for the information of Frontier and TNMP. In performing any such inspection or review or in accepting the Measures, Frontier makes no representation or warranty whatsoever as to the economic or technical feasibility, capability, safety or reliability of the Measures, their installation by Project Sponsor or their compatibility with the Host Customer's facilities.\n6.7.7 Project Sponsors must utilize their own resources to identify eligible customers, and shall verify income eligibility of Hard-to-Reach customers by using eligibility verification procedures required by the Public Utility Commission of Texas.\n6.7.8 Project Sponsor shall verify that the customer premise is in the electric distribution service territory of TNMP by obtaining the ESI ID number or meter ID number from the customer and inputting this number into the Program database.\n6.7.9 Project Sponsor will enter all required customer information, including income eligibility information in the case of Hard-to-Reach program participants, into the Program database, as well as any notes or comments from the screening process, to create a Project Application, into the Program database.\n6.7.10 Project Sponsor will contact customer to inform them to expect communication from various persons or entities that will assess the home for eligible Measures, install Measures, and perform post-installation inspection. In addition, Project Sponsor will facilitate scheduling of assessments, installations, or inspections if necessary.\n6.7.11 Project Sponsor shall conduct pre- and post- blower door and/or duct blaster testing in support of applicable Measures, and shall be required to submit current (within 2 years) manufacturer\u2019s calibration certificates for blower door equipment.\n6.7.12 Project Sponsor is responsible for verifying that the health and safety of customers will not be impacted by the installation of any of the above measures. This may include, but is not limited to, verifying carbon monoxide levels and minimum required ventilation rates.\n6.7.13 Project Sponsor shall update Measure installation data, a copy of the Customer Acknowledgement Form, and all other supporting data, pre- and post- photos, and other documentation required, using the Program database for each home as soon as Measures are installed.", Projects can be submitted until the Project Sponsor cap is reached or all program funds have been used. Funds will be taken out of the program budget upon the submission of a project. Please note that when funds have run out in the program, there is no guarantee that Utility will be able to pay incentives on non-submitted projects. It is the sponsor\u2019s responsibility to monitor the program budget and their project sponsor budget to determine if there are ample funds before implementing installations. .\n4.2 Within forty-five (45) days of receipt of an invoice, SWEPCO shall complete an inspection of a statistically significant sample of the Measure installations at the Project Site. For Projects involving less than thirty (30) installations, SWEPCO may aggregate the Projects for purposes of inspection, provided, however, that Project Sponsor shall not be penalized for the inspection failure rate of another project sponsor. This inspection shall be used to determine whether the Measures were installed and are capable of performing their intended function of producing Energy Savings and Peak Demand Savings. If SWEPCO reasonably determines that the Measures at the Project Site(s) have been installed, tested and inspected to the extent required by SWEPCO and found to be capable of providing Peak Demand Savings and Energy Savings in material compliance with the Contract Documents, the invoice will be approved as submitted. As set forth in the SOP Manual, a Load Factor cap governs the total payment allowed, based on the ratio between demand and energy savings from a Project. If SWEPCO is unable to inspect Measure installations at the Project Site, those Measures may be counted as failures.\n4.3 The Project Sponsor\u2019s progress towards completing the Project shall be determined independently by SWEPCO, who will evaluate the inspected, installed Measures on a measure-by-measure basis to calculate an adjustment factor for Energy Savings and incentives. This adjustment factor will consider the ratio of savings of the Measures that pass the inspection to the total incentive per Measure tagged for inspection on the invoice. The adjustment factor will then be applied to the entire invoice amount for payment. Failure of the Project Sponsor to timely complete or report a Project shall constitute an Event of Default, and may, in SWEPCO\u2019s discretion, result in disqualification of the Project. Bond Trustee certifying that such change is necessary and reasonable and that sufficient funds shall be available to the Trinidad Obligor to complete the Trinidad Project in accordance with such The Concessionaire shall procure and install new, specified and necessary equipments, plant, machinery, apparatus, services and its supporting infrastructure towards the Project. It shall keep all the necessary Project equipments adequately insured and shall pay regular and timely premium, at its own cost.\nk. In terms with the provisions of the Agreement, the Concessionaire shall make timely payment to Concessioning Authority, wherever required and applicable.\nl. The Concessionaire shall implement and make operational the Project as per the Project Milestone given in Article 2.8.\nm. The Concessionaire shall not remove any earth from the land/ Project Site until unless the local authorities have provided permission for it. In addition to this, the Concessionaire shall submit a copy of the document to the Concessioning Authority, wherein it has been clearly stated that the approval has been granted.\nn. The Concessionaire shall submit to the Concessioning Authority the drafts of all Project Agreements or any amendments or replacements thereto for its review and comments, and the Concessioning Authority shall have the right but not the obligation to undertake such review and provide its comments, if any, to the Concessionaire within 15 (fifteen) days of the receipt of such drafts. Within 7 (seven) days of execution of any Project Agreement or amendment thereto, the Concessionaire shall submit to the Concessioning Authority a true copy thereof, duly attested by a Director of the Concessionaire, for its record.\no.
