Common use of Project Commencement Clause in Contracts

Project Commencement. Subrecipient shall cause the Project to be operational no later than 60 days from the date of this Agreement. If the Project is not operational by that date, Subrecipient must submit a letter to Agency describing steps taken to initiate the Project, reasons for delay, and the expected Project starting date. If the Project is not operational within 90 days of the date of this Agreement, the Subrecipient must submit a second letter explaining the additional delay in implementation, and the Agency may, after reviewing the circumstances, consider the Subrecipient in default in accordance with Section 6.03 and may terminate the Agreement in accordance with Section 6.02.
