Common use of Prohibited Marketing Clause in Contracts

Prohibited Marketing. By way of example and not limitation, Client may not acquire nor utilize in any way a domain or subdomain that includes a Brand’s Proprietary Term (e.g., ▇▇▇.▇▇▇▇▇▇▇▇▇▇▇-▇▇▇▇▇▇-▇▇▇▇.▇▇▇, www.outlet.sale.branddomain.Client’▇▇▇▇▇▇▇.▇▇▇) if Client is not the Brand that owns the Proprietary Term. Client may use Proprietary Terms as a sub-directory of Client’s Site (e.g., Client’▇▇▇▇▇▇▇.▇▇▇/▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇). Such Prohibited Marketing will result in the immediate termination of this Agreement.
