Common use of Prohibited Discrimination Clause in Contracts

Prohibited Discrimination. Discrimination based on the Prohibited Grounds (“Prohibited Discrimination”) has occurred if an employee has been discriminated against regarding a term or condition of employment or otherwise adversely affected in the workplace based on one or more of the Prohibited Grounds. In rare and exceptional circumstances, Prohibited Discrimination may be justified based on a bona fide occupational requirement.
