Prior Environmental Impacts. Nothing in this Article will be construed to make Company liable in any way for any environmental impacts or release of Hazardous Substances affecting the Company Premises that occurred prior to Company’s entry upon the Company Premises or that occurred as a result of the actions of Authority or any of its employees, agents, or contractors.

Nothing in this Article will be construed to make the Airline liable in any way for any environmental impacts or release of Hazardous Substances affecting the Airline Premises that occurred prior to the Airline’s entry upon the Airline Premises or that occurred as a result of the actions of the Authority or any of its employees, agents, or contractors.

Nothing in this Article will be construed to make Company liable in any way for any environmental impacts or release of Hazardous Substances, as defined herein, affecting the Premises that occurred prior to Company’s entry upon or occupancy of the Premises by Company or that occurred as a result of the actions of Authority or any of its employees, agents, or contractors. The Parties acknowledge and agree that Exhibit D, Environmental Baseline Report, attached hereto and by this reference made a part hereof, states the condition of the Premises on the Effective Date of this Agreement.
