PRICE, DELIVERY, PAYMENT. Seller shall produce and deliver the Products, Services and perform all of its other obligations under the Agreement, at the prices set forth therein, and in accordance with these terms and conditions. Conditioned upon the timely delivery of conforming, non-defective Products and/or Services as required by the Agreement, EAI shall pay Seller the prices set forth within this Agreement in accordance with these terms and conditions. Unless expressly stated in these terms and conditions, Seller shall not be entitled to any other compensation and EAI shall not be obligated to pay any additional or different compensation, except the prices set forth as indicated on the referenced Purchase Order.
