Prevailing Wage Law. The Grantee certifies that all contractors and subcontractors performing work on the Project shall comply with state Prevailing Wages on Public Works, Chapter 39.12 RCW, as applicable to the Project funded by this contract, including but not limited to the filing of the “Statement of Intent to Pay Prevailing Wages” and “Affidavit of Wages Paidas required by RCW 39.12.040. The Grantee shall maintain records sufficient to evidence compliance with Chapter 39.12 RCW, and shall make such records available for COMMERCE’s review upon request.

Prevailing Wage Law. Where Applicable Laws, including CPUC decisions, orders, or rules, concerning prevailing wages require that Contractor pay prevailing wages for all or any part of the Work or Deliverables, or where EMS or Edison in their sole discretion determines that those prevailing wage rules and laws require that Contractor pay prevailing wages, then Contractor shall comply fully with all applicable requirements of those prevailing wage rules and laws and, upon EMS’s or Edison’s request, promptly demonstrate its full compliance with those rules and laws.
Prevailing Wage Law. This Agreement is subject to the requirements of the prevailing wage laws, including, but not limited to, Labor Code Section 1720 et seq., and Labor Code Section 1770 et seq., as well as Code of Regulations, Title 8, Section 16000 et seq., which require payment of prevailing wage rates and the performance of other requirements on certain “public works” and “maintenance” projects. Contractor shall defend, indemnify, and hold harmless Town, and its officers, employees, agents, and volunteers free and harmless from any claim or liability arising out of failure or alleged failure of Contractor to comply with such prevailing wage laws.

Prevailing Wage Law. Before any payment is made of any sum or sums due, Contractor and any or all subcontractors must file and receive an approved Intent form from the Industrial Statistician, certifying the rate of hourly wage paid each classification of laborer or xxxxxxx employed by them on such work and further certifying that no laborer or xxxxxxx employed by them for this work has been paid less than the prevailing wage rate in Whatcom County, which certificate and statement to be so filed will be verified by the oath of the Contractor or subcontractor, as the case may be, that they have read such statement and certificate subscribed by them, knows the contents thereof, and that the same is true as they verily believe. In case a dispute arises as to the prevailing wage rates for work of a similar nature and such dispute cannot be adjusted by the parties involved, the matter shall be referred to the Director of the Department of Labor and Industries of the State of Washington for arbitration, and their decision shall be final and conclusive and binding upon all parties involved in the dispute. Contractor acknowledges their familiarity with R.C.W. 39.12 as the same pertains to payment of prevailing wages and agrees to comply therewith. The Contractor shall be responsible for the compliance with the requirements of Prevailing Wage Law by all firms (including subcontractors, lower tier subcontractors, suppliers, manufacturers and fabricators) engaged in any part of the work necessary to complete this Contract.
Prevailing Wage Law. If public funds (which includes funds coming from Owner unless such funds will be reimbursed by a tenant under a lease with Owner) are intended to be used for the construction of the Project, all persons employed in the performance of the Work under this Agreement, or any subcontracts hereunder, will be paid not less than the general prevailing rates of per diem, holiday, and overtime wages prevailing in the locality for Work of a similar character pursuant to Chapter 2258 of the Texas Government Code (“Texas Prevailing Wage Law”). Failure to comply with this provision will subject Contractor to the penalties prescribed in the Texas Prevailing Wage Law including the forfeiture as a penalty to Owner the sum of $60.00 for each calendar day, or portion thereof, for each laborer, xxxxxxx, or mechanic, who is paid less than the stipulated rate for any Work done under this Agreement, whether by Contractor, or by any subcontractor working under Contractor. Owner has adopted the local prevailing and adopted wage rates derived from the most current applicable federal prevailing wage rates for Bexar County, Texas, as published by the United States Department of Labor, Dallas, Texas immediately prior to the execution of this Agreement, which is incorporated by reference herein for all purposes and must be attached as an exhibit to this Agreement.
Prevailing Wage Law. The term “Prevailing Wage Law” means any statute or ordinance that requires the Employer to pay its Employees working on public contracts at wage rates not less than those determined pursuant to that statute or ordinance to be the prevailing wages for comparable classes of workers in the geographical area where that contract is performed, including the Xxxxx-Xxxxx Act as set forth in 40 U.S.C. §276(a) et. seq., as amended from time to time, and any similar federal, state or municipal prevailing wage statutes.
