Common use of Presiding Officer Clause in Contracts

Presiding Officer. In an informal hearing, the City Manager or his/her designee shall be the presiding officer. The City Manager or his/her designee shall conduct the informal hearing in accordance with these procedures. The determination of the City Manager shall be final and binding. If the City Manager cannot serve as the hearing officer because of actual bias, prejudice or interest as defined by Government Code § 11425.40, then the mediator from the California State Mediation and Conciliation Service shall serve as the Presiding Officer. In such cases, the determination of the Presiding Officer shall be final and binding.
