Possession and Quiet Enjoyment. Lessee, upon payment of the rent herein reserved and upon the performance of all the terms of this Agreement, shall at all times during the lease term and during any extension or renewal term, peaceably and quietly possess and enjoy the leased property without any disturbance from Lessor or from any other person claiming through Lessor.

Site Sublessor covenants and agrees that unless a Site Sublessee Event of Default (as defined below) shall have occurred and be continuing and Site Sublessor (or the Indenture Trustee) has commenced the exercise of remedies pursuant to the Facility Lease, Site Sublessee shall enjoy quiet use, enjoyment and possession of the Ground Interest and neither Site Sublessor nor any Person claiming by, through or under Site Sublessor shall disturb Site Sublessee’s quiet use, enjoyment and possession of the Ground Interest or any portion thereof, and Site Sublessor shall not permit or suffer to exist on the Ground Interest or any part thereof any Lessor’s Lien.

Site Lessor covenants and agrees that, unless a Site Lease Event of Default (as defined below) by Site Lessee shall have occurred and be continuing and Site Lessor has commenced the enforcement of remedies, Site Lessee shall enjoy quiet use, enjoyment and possession of the Ground Interest and neither Site Lessor nor any Person claiming by, through or under Site Lessor shall disturb Site Lessee’s quiet use, enjoyment and possession of the Ground Interest or any portion thereof. Site Lessor shall not permit or suffer to exist any Lien or other encumbrance on the Facility Site arising by, through or under Site Lessor, except as permitted by any Operative Documents including Permitted Liens. Site Lessor further covenants and agrees to provide all necessary support and agreements to Site Lessee pursuant to the terms and provisions of the Support Agreement.

Possession and Quiet Enjoyment. Subject to the provisions of the Site Lease, and so long as no Lease Default or Lease Event of Default shall have occurred and be continuing, neither Sublessor nor any of its permitted successors and assigns shall disturb Sublessee's peaceful and quiet use and possession of the Site, and Sublessee shall enjoy all rights of Sublessor under the Site Lease; provided, however, Sublessor shall not be responsible for the acts of predecessors in title to Sublessor. Sublessor warrants that, as of the date hereof, it has not heretofore assigned or encumbered its interests acquired pursuant to the Site Lease or any part thereof.
Possession and Quiet Enjoyment. SECTION 26.01. Tenant shall have full rights of possession commencing on the Commencement Date. For so long as this Lease is in effect, Tenant may peaceably and quietly enjoy the Demised Premises without hindrance or molestation by Landlord or by any other person lawfully claiming the Demised Premises, subject to the terms and conditions of this Lease.
