Positions Outside the Unit. Employees who accept positions outside the bargaining unit may accumulate unit seniority for a period not to exceed one hundred and eighty (180) calendar days after the date of leaving the unit. If during this one hundred and eighty (180) calendar day period the employee is laid off or desires voluntarily to return to his/her former position and prevailing pay rate, the employee shall have the right to exercise seniority to the former positions or a substantially equivalent position of employment.

Positions Outside the Unit. Any nurse who takes a management position for any reason shall have her seniority frozen at the time of exit to the management position. Upon return, if such return is within three (3) months unless a longer duration is mutually agreed by the Association and the Employer, such seniority will be reinstated and accumulation will again commence.
Positions Outside the Unit. (a) A nurse who has agreed to substitute temporarily a position excluded from the bargaining unit shall be deemed to be covered by the Collective Agreement. Any nurse presently in the bargaining unit who elects to transfer to a position outside of the bargaining unit may be rehired in the bargaining unit after the Employer has complied with the job posting and recall provisions. In such event, the returning nurse shall be given a seniority date as of her date of last entry into the bargaining unit for purposes of job opportunity, layoff and other non-monetary benefits and provisions. She will retain her service date of date of last date of hire with the Employer for the purposes of determining her position on the salary schedule and for vacation entitlement. All seniority, illness, vacation and other credits obtained under this Agreement shall be retained and transferred with the nurse when she is reclassified from full-time employment to part-time employment and from part-time employment to full-time employment. A part-time nurse who changes her status to full-time will be given seniority credit on the basis of one (1) year of full-time service per two hundred (200) tours worked as a part-time employee, and vice-versa. ARTICLE EMPLOYEE FILES A copy of any completed evaluation which to be placed a file shall be first reviewed with the nurse. The nurse shall initial such evaluation as having been read and shall have the opportunity to add her views to such evaluation prior to it being placed in her file. It understood that such evaluations do not constitute disciplinary action by the Employer against the nurse. Each nurse shall have reasonable access to all her files for the purpose of reviewing their contents in the presence of her supervisor. A copy of the evaluation will be provided to the nurse at her request. No document shall be used against a nurse where it has not been brought to her attention in a timely manner. Any letter of reprimand, suspension or other sanction will be removed from the record of a nurse eighteen (18) months following the receipt of such letter, suspension or other sanction provided that such nurse's record has been discipline free for one year.

She shall retain all her service since her last date of hire with the Employer for the calculation of salary and any monetary benefit. The Administrator or her designate may grant a request for leave of absence for personal reasons provided that she receives at least one (1) month's clear notice, in writing, unless impossible, and that such leave may be arranged without undue inconvenience to the operations of the Nursing Home. Nurses when applying for such leave shall indicate the proposed date of departure and return. Such leave shall not be unreasonably withheld.

In the event the nurse returned to a position in the Bargaining Unit she shall be credited with the seniority held at the time of transfer and resume accumulation from the date of her return to the Unit. In the event that a nurse is transferred out of the Bargaining Unit under (a) above a specific term or task which does not exceed a period of six (6) months or an academic year and returned to a position the Bargaining Unit, she shall not suffer any loss of seniority, service or benefits. It is understood and agreed that a nurse may decline such offer to transfer and that the period of time referred to above may be extended by agreement of the parties.

Bargaining unit employees shall be given the first opportunity to fill the resulting vacancy. An employee who accepts a promotion with the Employer to a permanent position outside the bargaining unit and who is returned to the bargaining unit within three months shall be given credit for all seniority and service accrued while outside the bargaining unit plus all seniority and service accrued in the bargaining unit prior to the promotion. Should the employee return to the bargaining unit, all other shall revert to their previous positions. of Status A part-time employee whose status is altered to full-time will be given credit for seniority and service on the basis of fifteen hundred (1500) paid hours being equivalent to one (1) year of full-time seniority and service and In addition, an employee whose status is so altered will be given credit for hours accumulated since date of last advancement proportionate to a full year. Note: Provisions relating to retention of sick leave credits on transfer to part-time status will be dealt with under the sick leave issue and will not be deleted by this standard language. Similar treatment will apply to provisions on vacation or other credits on transfer.

Such leave shall not be unreasonably withheld, Leave When a death occurs the family of a nurse, the nurse shall be granted leave up to a of three (3) consecutive days without loss of pay around the date of the funeral provided that the nurse must be regularly scheduled to work such days to receive pay. For the purposes of Section (a), the family of a nurse", shall mean such current spouse, parent, parent of the current spouse, child, brother or sister, grandparent, son-in-law, daughter-in-law,' brother-in-law, sister-in-law and grandchildren. Where a nurse does not qualify under the noted conditions, the Home may nonetheless grant a paid compassionate leave. The Home, its discretion, may extend compassionate leave with or without pay.
