Positions Becoming Continuing. 37 Non-continuing employees who become continuing in the same position and site, or 38 same position and program, shall have their seniority date adjusted retroactive to the 39 consecutive non-continuing hire date after completion of the probationary period. 41 A R T I C L E I I 42 RIGHTS OF THE EMPLOYER 43 44 Section 2.1. 45 It is agreed that the customary and usual rights, powers, functions, and authority of management are 46 vested in management officials of the District. Included in these rights in accordance with and subject 47 to applicable laws, regulations, and the provisions of this Agreement, is the right to direct the work 48 force, the right to hire, promote, retain, transfer, and assign employees in positions; the right to 49 suspend, discharge, demote, or take other disciplinary action against employees; and the right to 1 release employees from duties because of lack of work or for other legitimate reasons. The District 2 shall retain the right to maintain efficiency of the District operation by determining the methods, the 3 means, and the personnel by which operations undertaken by the employees in the unit are to be 4 conducted.
