This Development Contract affects, encumbers, and otherwise concerns the lands described on the attached Exhibit A.

In the event the property plat has not been approved by the city within 90 days from the effective date of this contract and any extensions thereof, then at the option of the Buyer by giving written notice to Seller, this Contract shall terminate and the Earnxxx Xxxies shall be promptly refunded to the Buyer, unless it shall be otherwise agreed to in writing by the Buyer and Seller.
