Plant & Equipment. In the event of completion of the contract or early termination, the Company shall commit to pay the written down value at the time of completion or early termination on the Plant & Equipment that was purchased new during the Term of the Contract and is required for its Site except where this Plant and Equipment has already been fully purchased by the Company over the Contract Period. The Company may purchase any of the Contractor’s Plant & Equipment that was established or existing on the Site prior to commencement of the Contract. The purchase of that Plant & Equipment will be at the price agreed between the Company and the Contractor at the time of completion or termination of the Contract. If the Company does not want the Plant and Equipment due to the age or condition of a particular item/s of Plant & Equipment listed in the Schedules, the Contractor will take all action necessary including sale and/or disposal, termination of purchase agreements such as hire purchase contracts, reallocation of the Plant and Equipment to other contract work, etc. to minimise any additional payment required to be made by the Company to the Contractor. In all cases, payment to the Contractor shall not exceed two month of fixed and/or variable cost from the date of written notification to the Contractor by the Company’s Representative that the particular item/s of Plant & Equipment are surplus to the Company’s requirements.
