Physician Examination. The Engineer may require an employee to take an examination conducted by a licensed physician to determine the employee’s physical or mental capabilities to perform the duties of the employee’s position. If found not qualified, the employee may be placed on sick leave or disability leave. The cost of such examination shall be paid by the Richland County Engineer’s Department. The employee may, at the employee’s option and at total cost to the employee, seek a second examination of the same nature from a licensed physician of the employee’s choice. If the second physician finds that the employee’s physical or mental condition is such that the physician recommends that the employee is capable of performing the duties of the employee’s position, the employee may request a third opinion from a licensed physician. Upon request from the employee, the employer and the employee shall request that the two physicians select a third physician to conduct an examination of the employee of the same nature as conducted by the previous two physicians. The findings of the third physician shall determine the capability of the employee to perform the duties of the employee’s position and shall be binding on the parties. The costs of the third physician shall be shared equally by the employee and the Employer.
