Common use of PHOTOGRAPH RELEASE Clause in Contracts

PHOTOGRAPH RELEASE. I hereby give permission to Licensor, Agent, and the College to use any photograph or photographic image taken of me while participating in events sponsored by The Summit Apartments, or while I am in any public spaces, grounds, or offices of The Summit Apartments. It is agreed that the use of my photograph or photographic image shall in no way be used in any other forum other than for legitimate business and College purposes. I hereby grant Licensor, Agent, the College, or any of their authorized agents or designees acting with their authority and permissions, the irrevocable and unrestricted right and permission to copyright, in its own name or otherwise, and use, re-use, publish, or re- publish photographic portraits or pictures of me or which I may be included, in whole or in part, or composite or distorted in character or form, without restriction as to changes or alterations, in conjunction with my own or a fictitious name, or reproductions thereof in color or otherwise, made through any medium, and in any and all media now, or hereafter known for illustration, promotion, art, editorial, advertising, trade, or any other purpose whatsoever. I also consent to the use of any printed or website matter in conjunction therewith. I hereby waive any right that I may have to inspect or approve the finished product and the advertising copy or other matter that may be used in connection therewith or the use to which it may be applied. I hereby release, discharge, and agree to permission or authority or those for whom acting from any liability by virtue of any blurring, distortion, alterations, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in the taking of said picture or in any subsequent processing thereof, as well as any publication thereof, including without limitation any claims for libel or invasion of privacy. I do hereby release and forever discharge Licensor, , Agent, Queens College, The City University of New York, the Dormitory Authority of the State of New York, the City of New York, and the State of New York or any of their authorized agents, officers, employees and representatives from any and all demands, causes of action and/or judgments of whatever nature of character, past or future, known or unknown, whether in contract or in tort, whether for personal injuries, property damage, payments, fees, expenses, accounts receivable, credits, refunds, or any other monies due or to become due, or damages of any kind or nature and whether arising from common law or statue, arising out of, in any way, the use of my photograph or photographic image. This release contains the entire agreement between the parties and shall be binding upon and inure to the benefit of the successors and assigns of the Licensee and Licensor. (INITIALS)

I You hereby grant LicensorCampus West Apartments and their assigns, Agent, the College, or any of their authorized agents or designees those acting with their its authority and permissionspermission, the irrevocable and unrestricted right and permission to copyright, in its own name or otherwise, and use, re-use, publish, or re- publish and republish photographic portraits or pictures of me you or in which I you may be included, in whole or in part, or composite or distorted in character or form, without restriction as to changes or alterations, in conjunction with my your own or a fictitious name, or reproductions thereof in color or otherwise, made through any medium, and in any and all media now, now or hereafter known for illustration, promotion, art, editorial, advertising, trade, or any other legal purpose whatsoever. This release contains the entire agreement on this subject matter between the parties and shall will be binding upon and inure to the benefit of the successors and assigns of the undersigned. ADDITIONAL RESIDENT LICENSE AGREEMENT PROVISIONS: TERMINATION Termination Fee Schedule: On or before July 25, 2018 If cancellation request and supporting documentation is received by the office on or before July 25, 2018 Licensee will not be charged a cancellation fee. July 26, 2018 through August 23, 2018 If cancellation request and supporting documentation is received by the office between July 26, 2018, and on or before August 23, 2018, Licensee will be charged a cancellation fee equal to $50 per day from August 23, 2018 to the effective date of cancellation, which is 30 days after receipt. On or after August 24, 2018 with at least 30 days’ notice where request is approved If termination request and supporting documentation is received by the office on or after August 24, 2018 with at least 30 days’ notice, and the request is accepted by Licensor, the Licensee will be charged a cancellation fee based on $50 per day daily rate from August 24, 2018 to the last date of occupancy (or end of the notice period, whichever is longer), or the License Fee, whichever is less. On or after August 24, 2018 where request is not approved If termination request and supporting documentation is received by the office on or after August 24, 2018 (with or without full 30 days’ notice), and the request is not accepted by Licensor, then Licensee shall not be relieved of payment of the full amount of the License Fee. On or after August 24, 2018 with less than 30 days’ notice where request is approved If termination request and supporting documentation is received by the office on or after August 24, 2018 with less than 30 days’ notice, and the request is accepted by Licensor who also waives notice, then Licensee will be charged a daily rate of $50 August 24, 2018 to the last day of occupancy (or end of the notice period, whichever is longer), or the License Fee, whichever is less. Please Note: Licensee will not be released from liability due to school withdrawal or transfer, business transfer, loss of job, University or University Village conduct sanctions, marriage, divorce, health, roommate conflict or change in admissions status without prior approval of Licensor. (INITIALS)Except as provided herein, License Fees, late fees, and termination fees still apply in cases where the admission status has changed or Licensee is no longer attending the University.

March 15th, 2018 through May 1st, 2018 If cancellation request and Licensorsupporting documentation is received by the office between March 15th, 2018, and on or before May 1st, 2018, Licensee will be charged a $300 cancellation fee. (INITIALS)May 2nd, 2018 through July 1st, 2018 If cancellation request and supporting documentation is received by the office between May 2nd, 2018, and on or before July 1st, 2018, Licensee will be charged a $600 cancellation fee. July 2nd, 2018 through August 24th, 2018. If cancellation request and supporting documentation is received by the office between July 2nd, 2018, and on or before August 24th, 2018, the Licensee will be charged a $1,500 cancellation fee. On or after August 25th, 2018. If termination request and supporting documentation is received by the office on or after August 25th, 2018, Licensee will be charged a termination fee of $3,000 or for any License Fee installments due during the License Term, whichever is less. Please Note: Licensee will not be released from liability due to school withdrawal or transfer, business transfer, loss of job, University or The QUAD conduct sanctions, marriage, divorce, health, roommate conflict or change in admissions status. Except as provided herein, License Fees, late fees, and termination fees still apply in cases where the admission status has changed or Licensee is no longer attending the University.
