PHIPA. The Participant acknowledges that it is an agent of the Xxxxxx XXX as defined under PHIPA for the purposes of entering data into COVAX, and shall comply with any specific requirements with respect to the collection, use, disclosure and maintenance of Patient Data as required by the Xxxxxx XXX. The Participant further agrees that it will ensure all of its staff that handle or manage Patient Data are aware of the requirement to comply with PHIPA and to follow processes otherwise established by the Xxxxxx XXX (which will be consistent with PHIPA) related to the handling or management of Patient Data. The Participant further acknowledges that the Xxxxxx XXX is under agreement with the Ministry regarding the use of COVAX and Covid-19 vaccination and agrees that should Ministry guidelines or requirements change, it shall agree to change this Agreement so as to ensure the Xxxxxx XXX and it, as agent, can comply with Ministry obligations.

PHIPA. The Ambulance Service acknowledges that the CEPCP is a health information custodian bound by the Personal Health Information Protection Act, 2004, S.O. 2004 c. 3, Sched. A (PHIPA) and that any personal health information provided to Lakeridge Health in connection with the Agreement may be subject to that Act. The Ambulance Service further acknowledges that CEPCP is subject to the Freedom of Information and Protection of Privacy Act, R.S.O. 1990, c. F.31 and that this Agreement shall be interpreted in accordance with that Act.

  • HIPAA To the extent (if any) that DXC discloses “Protected Health Information” or “PHI” as defined in the HIPAA Privacy and Security Rules (45 CFR, Part 160-164) issued pursuant to the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) to Supplier or Supplier accesses, maintains, uses, or discloses PHI in connection with the performance of Services or functions under this Agreement, Supplier will: (a) not use or further disclose PHI other than as permitted or required by this Agreement or as required by law; (b) use appropriate safeguards to prevent use or disclosure of PHI other than as provided for by this Agreement, including implementing requirements of the HIPAA Security Rule with regard to electronic PHI; (c) report to DXC any use or disclosure of PHI not provided for under this Agreement of which Supplier becomes aware, including breaches of unsecured protected health information as required by 45 CFR §164.410, (d) in accordance with 45 CFR §164.502(e)(1)(ii), ensure that any subcontractors or agents of Supplier that create, receive, maintain, or transmit PHI created, received, maintained or transmitted by Supplier on DXC’s behalf, agree to the same restrictions and conditions that apply to Supplier with respect of such PHI; (e) make available PHI in a Designated Record Set (if any is maintained by Supplier) in accordance with 45 CFR section 164.524;

  • Information Technology Enterprise Architecture Requirements If this Contract involves information technology-related products or services, the Contractor agrees that all such products or services are compatible with any of the technology standards found at xxxxx://xxx.xx.xxx/iot/2394.htm that are applicable, including the assistive technology standard. The State may terminate this Contract for default if the terms of this paragraph are breached.

  • Health Plan An appropriately licensed entity that has entered into a contract with Subcontractor, either directly or indirectly, under which Subcontractor provides certain administrative services for Health Plan pursuant to the State Contract. For purposes of this Appendix, Health Plan refers to UnitedHealthcare Insurance Company.

  • Industrial Accident Leave 5.8.1 Unit Members will be entitled to industrial accident leave according to the provision in Education Code Section 87787 for personal injury which has qualified for Worker's Compensation under the provisions of the State Compensation Insurance Fund.
