Phase IV. BIDDING (Not applicable to this Agreement) 2.4.1 The Architect/Engineer, following the Owner’s approval of the Construction Documents and of the latest preliminary estimate of construction costs, shall assist the Owner in developing bid documents, and may be requested by the Owner to assist in preparing the construction agreement documents for the Project. 2.4.2 In the event the lowest responsive and responsible bidder’s bid submission exceeds either the funds appropriated for the Project or the final estimates provided by the GC, then the Architect/Engineer, in consultation with the Owner and GC, shall provide any modification(s) in the Construction Documents necessary to bring the cost of the Project within the Project’s budget as established by the Owner.

2.4.2.1 The Architect shall be appropriately compensated by the Owner for modification(s) to the Construction Documents, once said modifications(s) are approved by the Owner.
