Period of Appointment. The term “Period of Appointment” shall mean the period which commences on the Effective Date and, unless earlier terminated pursuant to Section 6, ends on December 31, 2008; provided, however, that the Period of Appointment may be extended for up to two additional years by Xxxxxxxx. Each annual extension shall occur automatically unless Xxxxxxxx provides the Company in writing that he will not be exercising the annual extension by December 1 of each year prior to the to-be-extended year. For example, the Period of Appointment will automatically extend to December 31, 2009 unless Xxxxxxxx provides notice that he will not be exercising the extension for 2009 on or before December 1, 2008.
