Performance of Construction Work. (e) Tenant covenants and agrees to commence the Construction Work promptly after obtaining the Approvals and thereafter to prosecute such work to completion with due diligence and continuity in a good and workmanlike manner, and in accordance with all Legal Requirements, Insurance Requirements and the provisions of Articles 7 and 10 and the other applicable provisions of this Lease. Promptly following the substantial completion of the Construction Work, Tenant shall furnish Landlord with (a) a written certification to Landlord by Tenant’s supervising architect, certifying that such architect has examined the aforesaid approved plans and specifications and that the New Improvements, as then constructed, have been completed substantially in accordance with such plans and specifications and complies with all Legal Requirements, (b) a copy or copies of the Certificate(s) of Occupancy for such New Improvements, (c) a complete set of “as built” plans in triplicate and a perimeter survey showing such improvements, as then constructed,
Performance of Construction Work. Section 3(d) of the Agreement is hereby deleted and replaced with the following: The City shall, at its own cost and expense, construct, or cause to be constructed. (i) at the Stadium, the Improvements in accordance with the Approved Plans and the Approved Construction Schedule and (ii) at the site identified on Exhibit B attached hereto, the Chargers' Facilities in accordance with the Approved Facilities Plans and the Approved Facilities Construction Schedule. Any and all construction work shall be done diligently, in conformity with all applicable legal and environmental requirements, including, without limitation, the Americans with Disabilities Act (42 X.X.X. §00000, et. seq.) and the Building and Fire Codes of the City of San Diego, in a good and workmanlike manner and under the supervision of the Approved Architect. Once the City commences the construction of the Improvements and the Chargers' Facilities, the City will diligently prosecute such construction to completion in accordance with the Approved-Construction Schedule and the Approved Facilities Construction Schedule, respectively, subject to delays resulting from Force Majeure Events outside of the control of the City, provided that the City gives the Chargers written notice of such delays promptly after the City becomes aware of the commencement of such delays. The City shall obtain all building permits necessary for the construction of the Chargers' Facilities and shall commence construction thereof in accordance with the Approved Facilities Construction Schedule. The City shall use its best efforts to complete construction of the Improvements and the Chargers' Facilities in accordance with the Approved Construction Schedule and the Approved Facilities Construction Schedule, respectively. The City at its own cost and expense shall cause the Approved Architect to prepare and provide to the Chargers monthly progress reports describing in reasonable detail the status of the construction of the Improvements and the Chargers' Facilities, which reports shall be delivered to the Chargers within twenty (20) Business Days after the end of the applicable month.

Performance of Construction Work. Funding Recipient shall undertake the Construction Work with diligence and continuity so as to reach Final Completion of the Project in accordance with the milestones and timetables set forth in the Completion Schedule. All Construction Work for the Project shall be undertaken in a good and workmanlike manner and in accordance with applicable Requirements and the Final Plans and Specifications. All materials and equipment utilized in connection with the construction of the Project Improvements shall be new and in good condition, fully operational, without patent or latent defects and suitable for their intended use. At all times during the performance of the Project, Funding Recipient shall maintain the Premises in a neat and orderly condition and shall protect the Premises against deterioration, loss, damage and theft.
Performance of Construction Work. Client shall cause Building Contractor not to permit the accumulation of building supplies, equipment, waste, material or rubbish within the Client Space, the Site or the Facility, and during the construction and upon completion shall cause all rubbish, implements, material and equipment to be timely removed from the Facility and Site. If any damage is done to any part of the Facility or the Site outside the Client Space, Client shall ensure that Building Contractor, at Building Contractor’s cost and expense, repairs and/or replaces same, in a manner satisfactory to Catalent, to the condition existing prior to commencement of the Construction Work. Client shall ensure that the Building Contractor and all subcontractors and material men employ the services of labor that will work in harmony with each other, and any others working in the area. If labor disputes arise, from any cause whatever, Client shall ensure that Building Contractor makes every effort to end same. Catalent may place its supervisory personnel and representatives on the job during the course of the Construction Work, at Catalent’s expense (except as set forth in Section 3.4), for the purpose of making any inspections and insuring that Client, Building Contractor, and Building Contractor’s subcontractors and material men comply with the terms of this Agreement. Client shall ensure that Building Contractor complies with all Catalent policies and procedures relating to safety, security, work processes and the procedures as outlined in [**] as directed by Catalent. Notwithstanding the foregoing enumeration of restrictions and conditions, Catalent may at any time during the course of the Construction Work impose such other reasonable restrictions, rules and conditions as may be reasonably necessary to ensure the proper completion of the Construction Work. Notwithstanding anything to the contrary in this Agreement, Client shall obtain Catalent’s prior written consent to shutting off any utilities to the Facility or the Site.
