Performance by Licensee. Provided the Licensee has performed its obligations under this Agreement, the Licensee shall have non-exclusive access to the Premises and the Utilities 24 hours a day, seven days a week, subject only to the Licensor’s reasonable security requirements, and shall enjoy the Premises and the Utilities without interference.
Performance by Licensee. LICENSEE shall use its best efforts to produce and sell the Licensed Product in the greatest quantity and of the greatest quality possible, and shall deal in good faith with LICENSOR at all times, and shall not engage in any activity which is against the interests of LICENSOR.
Performance by Licensee. LICENSEE’S OBLIGATIONS IN THIS AGREEMENT SHALL BE INDEPENDENT OF LICENSOR’S OBLIGATIONS HEREUNDER AND LICENSEE SHALL NOT BE RELIEVED OF ITS OBLIGATION TO PAY THE FEE AND OTHER CHARGES AND TO PERFORM COVENANTS CONTAINED HEREIN BY REASON OF ANY DELAY, FAILURE OR INABILITY ON THE PART OF LICENSOR TO PERFORM ANY OF LICENSOR’S OBLIGATIONS HEREUNDER. ANY DELAY, FAILURE OR INABILITY OF LICENSOR TO PERFORM HEREUNDER SHALL NOT CONSTITUTE CONSTRUCTIVE OR PARTIAL EVICTION FROM THE CLUB OR THE SPACE, NOR ENTITLE LESSEE TO ANY ABATEMENT OF THE FEE EXCEPT AS PROVIDED IN PARAGRAPH 11 OF THE AGREEMENT.
Performance by Licensee. Provided Licensee has performed its obligations under this Licence, Licensor agrees that Licensee shall have non-exclusive access to the Premises and Utilities subject to Licensor’s reasonable security requirements upon prior written approval of Licensor
Performance by Licensee. Licensee shall notify Xxxxxxxx Xxxxx of all marketing activities and provide representative copies of marketing materials to Xxxxxxxx Xxxxx. Xxxxxxxx Xxxxx shall have the right to comment and require revisions of Licensee’s marketing activities and materials, at Xxxxxxxx Xxxxx’x discretion.
Performance by Licensee. 14.1 Licensee shall sell or lease Licensed Product in minimum quantities to meet the following minimum royalty payments, or in the alternative, pay to Licensor minimum royalties according to the following schedule. Failure by Licensee to achieve the specified minimum sale or lease of Licensed Products, or in the alternative, pay to Licensor minimum royalties according to the following schedule shall be deemed a material breach of this Agreement.; (a) Starting from the date of the signing of this agreement to the last day of June, 1998, minimum royalties totaling Twenty Five Thousand Dollars ($25,000) shall have been paid to Licensor;
