Per Stirpes Clause Samples

Per Stirpes. Whenever a distribution is to be made “per stirpes”, the assets are to be divided into as many shares as there are then-living children and deceased children who left living descendants. Each living child shall receive one share and each deceased child's share shall be divided among such deceased child's then-living descendants in the same manner;

Per Stirpes. If per stirpes is selected, and any Beneficiaries predecease the Participant, their allocation will be split among their lineal descendants by right of representation. For any Beneficiaries who pre-decease the Participant, their share will be distributed to the Beneficiaryʼs children in equal shares and, if there are no children, their share will be distributed to the Beneficiaryʼs grandchildren in equal shares, and so on. The Custodian shall be authorized to rely on any representation of facts made by the Participant, the executor or administrator of the estate of the Participant, any Beneficiary, the executor Altruist Corp 6 or administrator of the estate of any Beneficiary, or any other person deemed appropriate by the Custodian in determining the identity of unnamed Beneficiaries.

Per Stirpes. When a distribution is to be made to a person’s descendants “per stirpes,” property will be divided into as many equal shares as there are: (1) members of the nearest generation of descendants who are then living; and

Per Stirpes. Except as may be otherwise provided in the Trust Agreement, whenever it is directed that any property of the Trust shall be distributed to or divided among a person’s descendants living at a particular time, per stirpes, this shall mean that such property shall be divided into as many equal shares as shall be necessary to provide one equal share for each then-living child of such person and one equal share for each deceased child of such person with then-living descendants; and one such equal share shall be set aside for each then-living child of such person, and one such equal share shall be divided in like manner among the then-living descendants, per stirpes, of each then deceased child of such person.

Per Stirpes. Per stirpes" means in equal shares among living --------------------- children of the person whose issue are referred to and the issue (taken collectively) of each deceased child of such person, with such issue taking by right of representation of such deceased child.
