Penalty Amount. If the Tenant does not pay the rent within the number of days constituting the grace period (from its due date) then the Landlord may decide to charge the Tenant an additional amount as a penalty. Record the penalty amount. (14)
Penalty Amount. The penalty for late cancellation is 50% of the price originally quoted for the container unloading or the palletised goods inbound service. In other words, they will be charged half of the agreed-upon price for the service they canceled.
Penalty Amount. In the event that a Completion does not occur on or before the applicable Milestone Date specified in Section 2.1(e), then each calendar day until such Completion has occurred, the Penalty Amount will be increased by Three Hundred Dollars ($300.00) for each Megawatt for which Megawatt Space has not been made available and passed its Electrical Testing Inspection; provided, however, that the Penalty Amount shall under no circumstances exceed One Million Seven Hundred Thousand Dollars ($1,700,000). Notwithstanding anything in Section 2.1(b) or Exhibit D to the contrary, in the event that the Penalty Amount is greater than Zero Dollars ($0.00), Purchaser may, by written notice delivered to Seller, reduce the aggregate amount of the Cash Payments payable in one or more future Installments by an amount equal to such Penalty Amount (with such reduction to be allocated among such Installments in the discretion of Purchaser as notified to Seller in writing). The Warrantors acknowledge and agree that the Warrantors (excluding Company) shall be jointly and severally liable for the Penalty Amount.
Penalty Amount. Notwithstanding any other provisions of this Agreement or of Schedule X, the Adjusted Working Capital Statement shall include within "Accrued Expenses" the Penalty Amount, if any, and shall attach as an exhibit to the Adjusted Working Capital Statement an explanation of, and supporting documentation for, the calculation of the Penalty Amount, including the revised installation schedule used to determine the Penalty Amount.
Penalty Amount. Farmers Ditch Company shall pay a total of $16000 as directed under Paragraph 4 to resolve all violations alleged in the ACL Complaint. This amount may be reduced by the amount spent on installation, maintenance, and data hosting costs of an appropriate measuring device upon presentation to the State Water Board with satisfactory evidence (i.e. paid invoices or receipts), but in no event shall the amount be less than $4500. The Penalty Amount is an appropriate resolution to the violations alleged in the ACLC based on consideration of the relevant circumstances as stated in the ACLC, as well as: FDC’s timeliness in returning to compliance, FDC’s genuine misunderstanding of the Board’s livestock watering prohibition, the relatively minor harm caused by the violations, the extensive commitments FDC has made to return to compliance, and the settlement purpose of this agreement.

Weatherford hereby acknowledges that at least $98,000,000 was involved in transactions described in the Factual Statement, and that such transactions by Weatherford, or its subsidiaries, violated 50 U.S.C. App. 1-44 and 50 U.S.C. §§ 1701-1706. Weatherford agrees that it shall pay the monetary penalty to the United States Treasury within thirty (30) days from Court approval of this Agreement pursuant to payment instructions as directed by the United States in its sole discretion. Weatherford releases any and all claims it may have to such funds. There is a separate agreement between Weatherford (and certain Weatherford subsidiaries and affiliates), and the Department of Commerce regarding disposition of certain administrative claims, which is attached. Weatherford has separately agreed with the Department of Commerce to settle its administrative liability with, among other conditions, a $50,000,000 administrative civil penalty, which is set forth in the attached agreement and is payable to the Department of Commerce. 4. Court is Not Bound: Weatherford and this Office understand that the Agreement must be approved by the United States District Court for the Southern District of Texas, in accordance with 18 U .S.C. § 3161 (h)(2). If that Court declines to approve this Agreement for any reason, this Office and Weatherford are released from any obligation imposed upon them by this Agreement, this Agreement shall be null and void, and this Office shall not premise any prosecution of Weatherford upon any admissions or acknowledgements contained herein, including in the Factual Statement. 5.

With respect to each period (quarterly or annual, as applicable pursuant to Section 5(c) of the EPI Agreement) in which PSC's performance of the Services fails to meet or fails to exceed the standards which have been mutually established for a Performance Metric, PSC will provide to SBC a credit in an amount equal to the product of (i) the Penalty Percentage for that Performance Metric, multiplied by (ii) the Penalty Pool for that Budget Period or a quarter thereof, as applicable; provided, however, that the maximum amount of credit that PSC is obligated to provide to SBC pursuant to this Section 3 in any one Budget Period or a quarter thereof, as applicable, with respect to all Performance Metrics shall not exceed, in the aggregate, the Penalty Pool for that Budget Period or a quarter thereof, as applicable.

With respect to each Budget Period in which PSC's performance of the Services fails to meet or fails to exceed the standards which have been mutually established for a Performance Metric, PSC will provide to SBC a credit in an amount, as determined hereunder by the SBC Operational Manager, not to exceed the Penalty Pool for that Budget Period; provided, however, that the maximum amount of credit that PSC is obligated to provide to SBC pursuant to this Section 3 in any one Budget Period with respect to all Performance Metrics shall not exceed, in the aggregate, the Penalty Pool for that Budget Period.
