Common use of Patient Care Clause in Contracts

Patient Care. Each party acknowledges that Data or obtained through HIE, External HIE, or CRISP Services is not a substitute for the clinical judgment of the subject Individual’s health care provider(s) or for a review of other medical records available to a Participant as to the subject Individual. All Participants and Participant Users are responsible for obtaining whatever information, including Data from sources other than the HIE or CRISP Services, deemed necessary for the proper treatment of the Individual under the applicable standard of care. Each Participant and each Participant User shall be solely responsible for its/his/her decisions and actions taken or not taken involving patient care, utilization management, and quality management for patients, including those resulting from, or in any way related to, the use of the HIE, External HIE, or CRISP Services or the Data made available through the HIE, External HIE or CRISP Services. Neither CRISP nor other Participants or Third Party Data Sources assume any control over or responsibility for the clinical decision making as to any patient of Participant. Further, Participant and its Participant Users assume no control over or responsibility for the clinical decision making as to any patient of other Participants.
