Past Due Fees. Lease fees will become past due ten days past the due date and the City will charge interest of 1.5% per month on past due lease fees.

Past Due Fees. Payment is considered past due if not received by SafetyNet within 15 days after the due date. SafetyNet may impose a late fee of $15 per month on any account past due. SafetyNet may also charge Caregiver bank fees for non-sufficient fund payments or payment denied requests.

Past Due Fees. Any and all payments not made by University when due will be subject to late charges of one and one-half percent (1.5%) per month of the overdue amount up to the maximum amount allowed by Minnesota law. All payments to be made by University under this Agreement shall be made free of any deduction, set-off or counterclaim. Where any fees owed to Mayo are more than two (2) months overdue, Mayo shall be permitted to suspend any Services being provided to University until such time as the overdue fees plus interest have been fully paid, and further, such nonpayment shall be a material breach and shall be sufficient cause for Mayo’s immediate termination of this Agreement. Any such suspension shall not relieve the University from paying past due fees plus late fees thereon and in event of collection enforcement, the University shall be liable for any costs incurred by Mayo associated with such collection including, but not limited to, legal costs, attorneys’ fees, court costs and collection agency fees. Past Due Fees. If Customer becomes thirty (30) or more days past due and fails to pay all past due fees within ten (10) days of EasyWorkforce’s written notice of such delinquency, EasyWorkforce may suspend access or delivery of any Software, Services or Products provided under this Agreement until all past due charges and any related interest are paid, or terminate the Agreement. Customer shall pay EasyWorkforce all costs of collection of past due amounts owed to EasyWorkforce hereunder, including without limitation, attorney fees, collection agency fees and court costs. EasyWorkforce reserves the right to update pricing of the Software, Services and Products at any time in its sole discretion.

In addition, the rate applicable under clause (a) or (b) above shall change based upon any change of the applicable Chase Bank Rate Margin or the Libor Margin; provided that any such change in such a margin such be effective on the first Business Day of the month following the month in which the Company shall have delivered, at least five (5) Business Days before the end of the month, to CITBC the financial statements demonstrating the change in EBITDA giving rise to such change in the margin, and any change in the Libor Margin shall affect only Libor Loans not yet funded as of that date. The rate hereunder shall be calculated based on a 360-day year. CITBC shall be entitled to charge the Company's account at the rate provided for herein when due until all Obligations have been paid in full.

  • Payments; Fees Agent may, in its discretion, receive and retain any amounts payable to a Defaulting Lender under the Loan Documents, and a Defaulting Lender shall be deemed to have assigned to Agent such amounts until all Obligations owing to Agent, non-Defaulting Lenders and other Secured Parties have been paid in full. Agent may use such amounts to cover the Defaulting Lender’s defaulted obligations, to Cash Collateralize such Lender’s Fronting Exposure, to readvance the amounts to Borrowers or to repay Obligations. A Lender shall not be entitled to receive any fees accruing hereunder while it is a Defaulting Lender and its unfunded Commitment shall be disregarded for purposes of calculating the unused line fee under Section 3.2.1. If any LC Obligations owing to a Defaulted Lender are reallocated to other Lenders, fees attributable to such LC Obligations under Section 3.2.2 shall be paid to such Lenders. Agent shall be paid all fees attributable to LC Obligations that are not reallocated.
