Passenger Station Facility Lease Agreement. Contemporaneously with the execution and delivery of this Agreement, the Department will execute and deliver the Passenger Stations Facility Lease Agreement in substantially the form of EXHIBIT D (Passenger Stations Facility Lease Agreement), whereby the Department will lease to the Commissions certain real property for the operation of each of the Passenger Stations Facilities enumerated in that exhibit. It is contemplated that the Passenger Stations Facility Lease Agreement may be amended or restated concerning the construction, maintenance, and use, during the term of this Agreement, of additional Passenger Stations Facilities. The Passenger Stations Facility Lease Agreement and other amendments or restatements shall impose no liability on the Department (or its officers, agents, or employees).
