Common use of Pass Clause in Contracts

Pass. If the results of a test requested by County indicate that the scale complies with law, the County will pay Disposal Contractor reimbursement costs of the tests. Disposal Contractor will request reimbursement for the same amount of money that it paid any subcontractor, without markup. • Fail. If the results indicate that the scale did not comply with law, Disposal Contractor will pay the costs of the tests and County is not obligated to reimburse Contractor. Disposal Contractor will correct all of County’s weigh tickets issued since the last correct scale test at its own cost.
