Pass-Through Warranties. Notwithstanding any provision of this Agreement to the contrary, Motorola will have no liability for third-party software or hardware provided by Motorola; provided, however, that to the extent offered by third-party providers of software or hardware and to the extent permitted by law, Motorola will pass through express warranties provided by such third parties.

To the extent such representations, warranties or indemnities cannot be passed through by ▇▇▇▇▇▇▇, ▇▇▇▇▇▇▇ agrees that Provider may assert or enforce any right that ▇▇▇▇▇▇▇ may have to enforce such representations, warranties and indemnities, or if such can only be enforced by ▇▇▇▇▇▇▇ and in its own name, upon Provider’s request, ▇▇▇▇▇▇▇ shall take all reasonable action requested by Provider to enforce such representations, warranties and indemnities.
Pass-Through Warranties. Without limiting City’s rights with respect to Contractor’s warranties under this Agreement, if Contractor provides any Deliverables covered by a third-party manufacturer’s warranty or indemnity, or both, Contractor shall: (i) provide City with a copy of each such warranty or indemnity; and (ii) if such warranty or indemnity does not by its terms pass through to the end-user, then to the extent permitted, Contractor shall assign to City or otherwise cause the manufacturer to grant to City all warranties and indemnities provided by such manufacturer.
Pass-Through Warranties. Provider agrees to pass through to Recipient any warranties given by its third party vendors in connection with hardware, software or other products or services used by Provider to provide the Services to the extent permitted by the terms and conditions of such warranties.

Such assignment shall not, however, relieve Vendor of any of the warranty obligations contained herein. Pass-Through Warranties. To the extent INAP is contractually permitted to do so, INAP shall pass-through to Customer any warranties and other obligations of the original manufacturer or vendor of third party materials, accessories, supplies, parts, services and products or any software licensed by a third party, including the right to indemnification from claims related to those products or services.
Pass-Through Warranties. Distributor acknowledge that all components of the Products are being manufactured for Developer by subcontractors or other entities other than the Developer. Developer extends to Distributor the warranties as to such components provided by such other entities to Developer for the length of time that such warranty remains valid for Developer. Notwithstanding any other provision in this Agreement, Developer shall not be held responsible for any damage which may result from a defective part except for the replacement of such part as set forth in the warranties provided by its subcontractors.
Pass-Through Warranties. In addition to the warranties set forth in this Article 14.2, to the extent Contractor has any rights or is the beneficiary of any warranties or representations from any third party with respect to any Deliverable Items, Contractor shall assign such rights and benefits to MSV; provided, however, if such assignment is prohibited under the agreement between Contractor and such third party, MSV shall be deemed to be a third party beneficiary of any such agreements.
