Participant Waivers. All Academy participants, including but not limited to students, instructors, members, or other guests on the jobsite, and other property at the jobsite or adjacent thereto shall sign a participant waiver from attached hereto as Exhibit B and by this reference incorporated therein. If Academy participants are under the age of 18, the participant's parent or guardian must sign the participant waiver. Academy is responsible for providing signed participant waivers prior to participants entering the Builder’s jobsite. PROTECTION OF PERSONS AND PROPERTY. Academy shall be responsible for initiating, maintaining and supervising all safety precautions and programs. Academy shall take reasonable precautions to prevent damage, injury or loss to employees, students, instructors, members, or other guests on the jobsite, and other property at the jobsite or adjacent thereto. Academy shall promptly remedy damage and loss to property caused in whole or in part by Academy, or by anyone for whose acts Academy may be liable.

Participant Waivers. Organizer shall ensure that each tournament participant, or legal guardian of each tournament participant if the participant is a minor, executes and provides to the Organizer a properly executed Waiver, attached hereto as Exhibit “B.” In the event a participant or his or her guardian does not provide a properly executed Waiver prior to participating in a tournament, any such participant shall not be permitted to participate in the tournament. Should Organizer fail to obtain a properly executed Waiver by a participant who makes a claim against the City related the participant’s participation in a tournament, Organizer shall hold harmless, defend, and indemnify the City pursuant to Section 12 of this Agreement. Participant Waivers. The Town or SkiCo, as applicable, shall have the sole responsibility for requiring, collecting and storing “Waiver, Release, and Indemnity Agreements” from each and every participant entering onto the Xxx 0 Xxxxx Xxxxx for the purpose of participating in any event where such an agreement is required. The Town or SkiCo, as applicable, shall have the sole responsibility of determining whether such waivers shall be required for any given event the Town or SkiCo, as applicable, holds on the Xxx 0 Xxxxx Xxxxx. All “Waiver, Release, and Indemnity Agreements” shall include the Developer and the Master Association as released parties and be in a form acceptable to the Developer and the Master Association.
