All members covered by this Agreement shall accumulate one (1) day per month up to a maximum of eight (8) per year of sick leave not to exceed one hundred eighty-five (185) days. In the event of death, all unused sick leave days will be paid at the prevailing rate to the employee's beneficiary. On June 30th, any days of sick leave greater than one hundred eighty-five (185) shall be removed from the employee\u2019s accumulation and the employee shall be paid thirty-five dollars ($35.00) for each day removed.\nB. Sick leave chargeable against accrued time may be taken for the following reasons:\n1. The employee may use all or any portion of leave days accumulated to recover from his/her personal illness or disability.\n2. Serious illness or medical care of the immediate family members or other dependents which requires the presence of the employee in order to provide the necessary care. Immediate family under this section shall include spouse, children, parents, grandparents, parents-in-law and step-parents.\n3. If an employee uses deduct time in a year, their next years sick and personal accruals will be reduced by the same amount, except for deduct time taken as a result of Unpaid Leaves of Absence in Article 11.\nC. When death occurs in an employee's immediate family, the employee upon request shall be excused for up to any of the first three (3) scheduled working days following the date of death providing he/she attends the funeral. Any deviation must have administrative approval. A deviation shall be granted when the funeral is not within the three (3) day period. The days will not be deducted from sick leave. Immediate family is to be defined as follows: mother, father, brother, sister, wife or husband, son or daughter, mother-in-law, father-in-law, grandparents, grandchildren, brother-in-law, sister-in-law, stepchildren, stepparents, son-in-law, daughter-in-law, or a member of the employee's household. An additional two (2) workdays may be charged against accrued sick leave as travel time. Any employee selected to be a pall bearer for a deceased employee will be allowed up to one (1) day funeral leave with pay, not to be deducted from sick leave. If an employee within this bargaining unit dies, the Local Union President, or his/her representative (1), shall be allowed up to one (1) funeral leave day for the exclusive purpose of attending the funeral. The day shall not be charged to sick leave. One day chargeable against accrued sick days may be granted to attend the funeral of a close friend or relative.\nD. If the employer has reason to suspect abuse of leave days, the employee may be asked to provide verification of the reason for absence. For a continuing illness or disability, the employee will provide verification upon request.\nE. An employee who serves on Jury Duty will be paid the difference between his/her pay for jury duty and his/her regular pay. Employees paid for jury duty are required to report to their workstations on days when their services are not required by the court.\nF. Each employee will be covered by the applicable Workers\u2019 Compensation Laws. Employees may use a portion of his/her accumulated sick leave to make up the difference between Workers\u2019 Compensation and his/her regular salary. The total amount received from sick days and Workers\u2019 Compensation shall not exceed the employee\u2019s regular pay.\nG. All employees will be entitled to three (3) days personal leave per school year. Such leave must be requested at least twenty-four (24) hours in advance except in an emergency. Personal days shall not be used to extend a vacation, holiday or travel time related thereto. Unused personal days will carry forward at the end of each school year. No more than 6 personal days can be carried forward into the next school year. The days carried forward can only be used during winter and spring break.\nH. recognize the importance of professional staff members being in the classroom regularly and therefore all absences will be considered prior to approval of other school-related absence requests. The administration may restrict school-related absences if a high use of Personal Business Days or other paid leave days have already been approved and/or have occurred.\nSection 1: Twelve (12) days sick leave per year with full pay shall be granted in case of necessary absence due to:\na. When the total number of requests for a specific day exceeds five (5), the District can ask teachers to reschedule their leave. It is understood that some days cannot be rescheduled (one-time-only events). In such instances, the District will seek other means to fill anticipated subbing needs, including rescinding approval for conferences and in-district curriculum meetings.\ne. In cases where extenuating circumstances exist in the aforementioned sections of this article, the teacher may appeal to the Superintendent whose decision shall be final.\nSection 2: Part-time teachers shall accrue sick leave on a pro-rated basis and shall be charged the use of sick leave on a pro-rated basis. For example: a teacher teaching one-half time will be credited with six (6) full days of sick leave for a year. If this one-half time teacher were to be absent twelve one-half days in a year, the teacher would be charged for six (6) full sick days.\nSection 3: Each teacher will be given a sick day balance on a bi-weekly basis via their check stub. In no case shall the accumulated total exceed one hundred fifty-five\nSection 4: Leave provisions shall apply to full-time personnel. Teachers employed on less than a full-time contract basis shall have their sick leave pro-rated.\nSection 5: The Superintendent or designee may request a verification certificate for illness signed by a physician in the event of irregular attendance and/or may request other appropriate verification as needed whenever abuse of any paid leave is observed.\nSection 6: In the event that the Board questions a teacher's fitness to return following the use of sick leave in excess of five (5) work days, the teacher must submit a written statement from his health care provider, physician and/or psychologist, to the effect that he is physically and/or mentally able to perform the essential functions of his assigned duties and responsibilities. If after returning to active employment, the teacher's fitness is still in question, the Board may, after discussing the problem with the teacher require an examination by a physician or psychologist of the Board's choice. All the full time and regular part-time employees with seniority shall earn sick leave at the rate of one (1) day per full calendar month of paid work. The unused sick leave days can be accumulated to 115 days as of October 1, 2004 for the duration of continuous employment, provided that employees will not be paid for a day of sick leave before they have earned it. Employees with more than 115 accumulated sick days as of October 1, 2004, shall not have those days reduced other than through the use of sick days but shall not be allowed to accumulate days so long as the employee has more than 115 days.\nB. Leave of absence with pay chargeable against the employee's accumulative sick leave will be granted for the following:\n1. Personal illness of the employee.\n2. Upon the request of the Association, the Board may grant a leave of absence to a teacher for the purpose of conducting official Association business, in accordance with the following guidelines:\n1. Except for good cause, request for leave day shall be made in writing to the Superintendent not less than five (5) working days before the leave.\n3.
