Ownership by Customer. Customer retains all right, title, and interest in and to the Customer Data and Customer’s Confidential Information (Customer Properties).
Ownership by Customer. Except as otherwise set forth herein, Customer shall own all right, title and interest in Customer intellectual property that is wholly developed and owned by Customer prior to the Effective Date of this Agreement or independently developed by Customer without the benefit of any Cisco intellectual property.
Ownership by Customer. Customer is the sole owner of all intellectual property rights in the Customer Data (excluding any Platform Analysis) and in any report provided to Customer through the Platform based on Customer Data ("Reports"). Customer hereby grants Ironscales a non-exclusive right to use the Customer Data and Reports during the Term in order to provide the Platform.
Ownership by Customer. No purchased Equipment provided to you by SAT-MENA shall be deemed fixtures or part of our realty. Your ownership of such Equipment may be displayed by notice contained on it. You shall have no right to sell, mortgage, otherwise encumber, alter or tamper with the Equipment at any time. Any reinstallation, return, or change in the location of the Equipment shall be performed by us at our service rates in effect at the time of such service. You are responsible for preventing the loss or destruction of Equipment and we recommend that your Equipment be covered by your homeowners, renters or other insurance policy.
Ownership by Customer. As between Customer and CSG, Customer is and shall remain the sole and exclusive owner of all rights, title and interests (including all Intellectual Property Rights) in and to the Sony DADC Digital Supply Chain Services (excepting the Content Direct Services portion thereof), Consumer Information, Consumer Usage Data, Customer Content, Customer Confidential Information, Customer Intellectual Property, CustomerCD Embedded Site and any improvements, adaptations and other such modifications of the same that are developed by or for Customer, and any Merchandise.
Ownership by Customer eXalt acknowledges and agrees that: (i) as between eXalt and Customer, Customer owns all the right, title and interest in the Customer Content and the Customer Brand Features, all derivatives, enhancements and improvements thereof (except the Application Service Provided Content), and all Intellectual Property Rights therein; (ii) nothing in this Agreement shall confer in eXalt any right of ownership in the Customer Content or the Customer Brand Features, other than the limited licenses set forth in Section 3.3 above; and (iii) eXalt shall not now or in the future contest the validity of the Customer Brand Features. Customer grants no licenses except for those expressly set forth in this Agreement and shall retain all rights not expressly granted hereunder. To the extent eXalt or its employees may acquire any right or interest in any of the foregoing by operation of law, then as additional consideration for favorable provisions of this Agreement, eXalt hereby irrevocably assigns and transfers to Customer all right, title and interest worldwide in and to such Customer Content, whether or not patentable or copyrighted, made or conceived or reduced to practice, and to all modifications and derivative works thereof (except the Application Service Provided Content), and to all Intellectual Property Rights related thereto. eXalt shall maintain and enforce agreements and policies with its employees sufficient to give effect to the provisions of this Section 3.6.
Ownership by Customer. As between the Parties, Customer shall retain and own all right, title and interest in, to and under the Customer Technology, and [***] = Portions of this exhibit have been omitted and filed separately with the Securities and Exchange Commission. Confidential treatment requested under 17 C.F.R. Sections 200.80(b)(4) and 230.406. EXECUTION VERSION Customer shall have the right, but not the obligation, to file applications for, and to control the prosecution and maintenance of, the Customer Technology and to enforce all rights therein. For the avoidance of doubt, Customer has no rights to improve or modify the Codexis Technology.
Ownership by Customer. As between Customer and Developer, Customer shall own all right, title and interest in and to the Content, Customer Marks and User Information. Developer may make only such copies of the Content and Customer Marks as may be necessary to perform the services under this Agreement, including without limitation reasonable backup and archival copies. Developer shall post on the Web Site any copyright notices or other notices relating to the Content and Customer Marks, as instructed by Customer.
Ownership by Customer. All Data collected at Customer’s request (as described in the Ordering Document) from or through any Wave Glider ("Customer Data") will be owned by Customer, subject to the license in Section 3.2 and the restrictions set forth in Section 3.4 and 3.5.
