Common use of Owner Trustee Clause in Contracts

Owner Trustee. This Agreement has been executed on behalf of the Issuer by The Bank of New York Mellon, not in its individual capacity but solely in its capacity as Owner Trustee of the Issuer, and in no event will The Bank of New York Mellon in its individual capacity or a holder of a beneficial interest in the Issuer be liable for the Issuer’s obligations under this Agreement. For all purposes under this Agreement, the Owner Trustee will be subject to, and entitled to the benefits of, the Trust Agreement. Neither the Issuer nor the Owner Trustee will have any liability for any act or failure to act of the Administrator, including any action taken under a power of attorney given under this Agreement.
