Own Funds Sample Clauses

Own Funds. The Collateral Agent shall not be under any obligation to take any action other than as expressly set forth in this Common Agreement or the other Loan Documents to which it is a party that involves any expense or liability, the payment of which, within a reasonable time, is not, in the reasonable opinion of the Collateral Agent, assured to it. Nothing in this Common Agreement shall be interpreted to require the Collateral Agent to advance or expend its own funds to make any payments hereunder. The Collateral Agent shall not be required to invest, or be under any liability for interest, on any monies at any time received by it pursuant to any of the provisions of this Common Agreement, except as otherwise expressly provided herein or in any other Loan Document to which it is a party.

Own Funds. The Class A-3 Note Agent shall not be required to, and shall not, expend or risk any of its own funds or otherwise incur any financial liability in the performance of any of its duties hereunder if it shall have reasonable grounds to believe that repayment of such funds or adequate indemnity against such liability in accordance with the terms hereof is not reasonably assured to it.
