Common use of Outstanding Fees Clause in Contracts

Outstanding Fees. Termination shall not relieve Medical Practice of the obligation to pay any fees or expenses accrued or payable to Modernizing Medicine prior to the effective date of termination. Additionally, in the event of the termination of this Agreement in the situation where Medical Practice has exercised its right to receive a discount based on an Advance Payment, Modernizing Medicine will return the unused portion of the Advance Payment, less any discounts previously given.
