Outside Employees Clause Samples
The "Outside Employees" clause defines the rules and limitations regarding the involvement of individuals who are not direct employees of the contracting parties in the performance of the agreement. Typically, this clause clarifies whether contractors, consultants, or third-party personnel can be used to fulfill obligations, and may set requirements such as prior approval or compliance with confidentiality standards. Its core function is to manage risk and ensure accountability by specifying who is permitted to work on the contract and under what conditions, thereby protecting sensitive information and maintaining quality control.
Outside Employees. It is agreed that the Employer and the Union have a common interest in protecting work opportunities for all employees covered by this Agreement. It is further agreed that the displaying, servicing, ordering and demonstrating of merchandise for sale can be handled at the Employer’s discretion by nonbargaining unit display representatives, sales representatives, vendor representatives, or any other employee of vendors who are servicing their merchandise to the Employer. In no event, however, shall any bargaining unit employee be laid off or reduced in hours as a result of work being performed by any sales representative, vendor or display representative described above.
Outside Employees. The normal work day (day shift) shall consist of a scheduled period of eight (8) hours of work between the hours of 7:00 a.m. and 5:00 p.m. The normal work week shall consist of five (5) such days, being Monday to Friday inclusive.

Outside Employees. For Outside Employees the construction, preparation and paving of roads. Said shifts may be instituted during late Spring, Summer and early Fall, when maximum daylight hours are available and shall consist of not more than two (2) eight (8) hour non‐broken shifts, lunch time excluded, between the hours of 5:30 a.m. and 10:30 p.m., Monday to Friday, inclusive. During the Spring, Summer, and Fall, when maximum daylight hours are available, Outside Employees may, at the Employer's discretion, work between the hours of 7:00 a.m. and 3:30 p.m., Monday to Friday inclusive. This provision does not restrict any hours of work flexibility that is provided elsewhere in the Collective Agreement.
Outside Employees. A. An outside employee is employed to:
1. Perform the work of an absent bargaining unit member.
2. Fill a vacant position during the interim of a posting and hiring.
3. Fill the position of an employee serving a fifteen (15) work day trial period.
B. Outside employees shall not:
1. Be represented by this Union or this Agreement.
2. Be entitled to any benefits under this Agreement.
3. Achieve seniority status for time worked in such capacity.
4. Be used in any manner to do bargaining unit work if there are bargaining unit members on a layoff.
5. Be used in such a manner as to avoid filling the positions with a bargaining unit member.
6. Be given preferential treatment as to working hours, working conditions or overtime.
7. Be used for a period to exceed 45 work days per vacancy, unless the assignment is to cover an employee’s leave of absence as defined in Article 18.
8. Be used for temporarily vacant positions prior to the recall of laid off/displaced employees.
C. Exceptions to the above shall be mutually agreed to by the Union and the Employer.
Outside Employees. The normal daily hours of work for Outside Employee classifications is eight (8) hours, unless otherwise noted in Schedule “C” or Article 14.02. Individual departments will establish shifts within a daily time frame of 7:00 a.m. to 4:30 p.m. Monday through Friday inclusive. Unless otherwise noted in Article 14.02, one (1) unpaid meal break of one- half (½) hour will be allowed for a shift of eight (8) hours. For those positions not currently considered “exceptions” to the normal hours of work provisions, Department Heads shall provide Employees with a minimum of forty-eight (48) hours’ notice of a temporary change in their daily hours of work and a minimum of ten (10) working days notice of a change in their daily hours of work that exceeds five (5) continuous working days. Additional exceptions may be made by the Municipality with the concurrence of the Association. Present exceptions include:
Outside Employees. Subject to paragraph 12.02, the standard work day of Outside Employees shall be eight (8) consecutive hours between 6:00 a.m. and 4:30 p.m. exclusive of an unpaid one-half (1/2) hour lunch period. Subject to paragraph 12.03, the standard work week of Outside Employees shall consist of five (5) consecutive working days from Monday to Friday inclusive. The Employer shall provide forty-eight (48) hours’ notice of a change in an employee’s daily hours. Should the appropriate notice not be provided then the overtime provisions of Article
Outside Employees. When a vacancy occurs inside the bargaining unit the Employer shall notify the employees by posting a notice on the bulletin board. The Employer shall also post notices in respect to vacancies in positions up to and including Manager of Operations. When the Employer does not intend to fill the vacancy, it shall advise the Union of its decision.
Outside Employees. The standard workweek shall consist of forty (40) hours per week as follows: Winter hours will not be in effect before the first Friday after Thanksgiving and will not continue past the last Thursday in April. The Employer shall consider commencing and/or maintaining summer hours as long as reasonably possible, depending on the weather and such dates remain solely the decision of the Employer based on operational and service requirements. These dates do not apply to the transferring of employees between work depots for seasonal purposes. Monday to Thursday – 7:00 a.m. to 4:30 p.m. with one-half (1/2) hour unpaid lunch break ideally taken between 11:00 a.m. and 12:00 noon, and Friday 7:00 a.m. to 11:00 a.m. Notwithstanding the above, employees who commence their start time prior to 7:00 a.m. shall be entitled to end their shift nine and one-half (9 ½) hours thereafter, (Monday to Thursday) which shall include a one-half (1/2) hour unpaid lunch provided the employee and their Operations Supervisor or Manager of Operations are in mutual agreement to end the work day after the nine and one-half (9 ½) hour period. All time prior to 7:00 a.m. shall be paid time and one-half (1 ½). Summer hours will be in effect when winter hours are not in effect. Monday to Thursday inclusive - 6:30 a.m. to 5:00 p.m. with one-half (1/2) hour unpaid lunch break ideally taken from 11:30 am to 12:00 noon. For the period of summer hours, as defined in 13.01, an on-call system shall be in place for roads, related to after hours emergency calls. Works Department employees shall have an opportunity to sign-up for participation in this program prior to commencement of the summer hour season. Employees who sign up will be placed into a weekly rotation beginning at the end of the last working day of each week and ending at the start of the last working day of each week. Employees will be expected to carry a pager at all times when on-call and shall have the use of a Works Department vehicle at night and on the weekends. Employees are required to be available to respond to all calls during the period they are on call. When called out, employees shall be paid a minimum of three hours each time they are called. If called again while attending a call, or during the initial three hour period of the call-out, the employee will only be paid for the original call-out if the work of the subsequent call is completed during the original period.
