Outside Brokers. If C&W recognizes an outside broker authorized to represent the purchaser or tenant in a transaction for which a commission is payable hereunder, C&W will request such broker to agree to accept the outside broker portion of the commission computed and payable in accordance with the annexed Schedule, and if such other broker agrees, Owner will pay C&W the commission computed and payable in accordance with the annexed Schedule out of which C&W will pay to such other broker its agreed upon commission and retain the balance of the commission as C&W's compensation. If the other broker does not so agree, then negotiations will be suspended until such agreement is obtained. The term "outside broker" means a broker other than Xxxxx X. Xxxxxxxx, SIOR or Xxxxxx X. Xxxxxxx.

Outside Brokers. Manager may not without Owner’s consent in each instance, enlist other brokers to assist Manager in attempting to lease space in a Project (each, an “Outside Broker”). Notwithstanding the foregoing, Owner’s consent shall not be required in connection with an Outside Broker engaged by a prospective Tenant in connection with leasing space in a Project (an “Outside Tenant Broker”). Manager shall use its commercially reasonable efforts to cause any Outside Broker involved in such Lease transaction to enter into, prior to the time that it may be reasonably anticipated that negotiations of a Lease shall be entered into or such other time that Owner directs that Manager do so, a form of agreement between Manager and any Outside Broker as Manager and Owner may approve (each of the foregoing sometimes herein called an “Authorized Outside Broker Agreement”). Manager agrees not to enter into any agreement with an Outside Broker without the prior approval of the terms of such agreement by Owner. In the event that an Outside Tenant Broker shall be entitled to payment of a commission in connection with a Lease, Owner agrees that it shall be responsible for paying to Manager (for the payment to the Outside Tenant Broker) any commission owed to such Outside Tenant Broker (the “Outside Broker Commission”), provided, however, Owner shall not be required to pay any portion of an Outside Broker Commission which, when taken together with the Commission that would otherwise be due and payable to Manager had an Outside Tenant Broker not been engaged, exceeds one-hundred fifty percent (150%) of the Commission otherwise payable to Manager (the “Owner Commission Cap”). Manager shall have the sole and exclusive responsibility to pay (i) any portion of a commission payable to an Outside Tenant Broker after Owner has made payments up to the Owner Commission Cap with respect to such Lease and (ii) any commission owed to an Outside Broker that is not an Outside Tenant Broker or that Owner has not otherwise consented to pay such Outside Broker, subject, however, in all events to the prior receipt by Manager of the Commission with respect to such Lease in accordance with this Agreement. Outside Brokers. (a) If a licensed real estate broker other than Manager (an "Outside Broker") is the procuring cause of a Lease or extension or modification thereof or represents the tenant thereof, Owner shall pay such Outside Broker the amount required pursuant to such Outside Broker's written brokerage or commission agreement, provided, however, that the amount of any such commission shall not be greater than the product of $1.00 per rentable square foot of space subject to such Lease, multiplied by the number of years (not to exceed fifteen (15)) in the term of such Lease (e.g., for a ten-year lease for 30,000 rentable square feet, the commission to the Outside Broker would be equal to $300,000 ($1.00 x 30,000 x 10)), unless Owner shall otherwise agree in writing.
Outside Brokers. (“Outside Broker(s)”) that procure prospective buyers of the Property with the understanding that Outside Brokers will look only to the Purchaser for compensation if Outside Brokers are involved in the Sale of the Property. Broker shall be responsible for entering into a registration and confidentiality agreement with any Outside Brokers.
Outside Brokers. Owner acknowledges that Outside Brokers may be involved in the leasing of space at the Property. Agent will advise Owner of the involvement of any Outside Brokers in any pending transaction. In the event any Outside Broker is involved, Agent will use reasonable efforts to have each Outside Broker execute and deliver to Owner an Outside Broker's Commission Agreement, the form and substance of which shall be subject to Owner's approval. Agent will deliver a fully executed counterpart of the Outside Broker's Commission Agreement to Owner promptly upon the execution thereof.
Outside Brokers. If an Outside Broker is entitled to a leasing commission in connection with the leasing of space at the Property, then Owner will pay a leasing commission to the Outside Broker pursuant to the Outside Broker's Commission Agreement and will pay to Agent a Leasing Commission equal to thirty-seven and one half percent (37.5%) of the Leasing Commission amount otherwise payable to Agent (were Agent the sole leasing agent) set forth in Exhibit E. Agent will advise Owner of the involvement of any Outside Broker.

Outside Brokers. Outside brokers or sales agents are not permitted on the property of Crate’s Belleville, and absolutely no activity related to the brokering of boats is permitted without the approval of the Marina Office.
Outside Brokers. Agent reserves the right to cooperate with other licensed real estate brokers not affiliated with Agent. In the event any broker other than Agent cooperates with Agent, represents the buyer or tenant, and has procured such party, Owner shall pay the commission to Agent and Agent shall be responsible for paying the cooperating broker a portion of the commission paid hereunder. No third party beneficiary rights are created by this Agreement.
Outside Brokers. Manager is hereby authorized to cooperate with Outside Brokers in leasing space within the Property and to enter into brokerage agreements (each, an "Outside Broker Agreement") with such Outside Brokers on behalf of Owner as Owner's agent. All Outside Broker Agreements shall be subject to written approval by Owner. In the event that an Outside Broker shall procure a tenant for space within the Property and such tenant enters into a lease with the Owner, Owner shall pay the Outside Brokers and Manager any commissions due in accordance with the Outside Broker Agreement with such Outside Broker.
